lake. He requested to locate the home within 100 feet of the ordinary high water mark instead of <br />150 feet so they have an additional 50 feet to site the home. He explained the DNR classification <br />of recreational water allows a 100-foot setback as does Oak Grove for this lake. He stated there <br />are many homes, 6 to 8 built along the lake, that have about 50 foot setbacks. Mr. Canner stated <br />this is the last lot to be built on Rogers Lake in Ramsey, so he feels the "horse is out of the barn" <br />with regard to restricting development along this lake. He stated they would like to build within <br />a reasonable distance of the lake but have not yet filed for a variance. He asked if another option <br />would be to reclassify this lake to conform with the classifications that other communities use. <br /> <br />Chairperson Nixt stated the Planning Commission could provide some direction on the options <br />and make a recommendation on the sketch plan. He asked Mr. Canner if he would like the <br />Planning Commission to consider the sketch plan at this time before he learns whether a variance <br />is an option. He stated he doubts the Planning Commission can make Anoka County change <br />their mind about requiring the additional road right-of-way. <br /> <br />Commissioner Johnson stated it is not unusual, with bodies of water and developed properties, to <br />bring the site closer, noting that Bowers Drive had a 150-foot setback but none are built at that <br />distance. He asked how this home would line up with the other existing homes. <br /> <br />Mr. Canner explained that with a 100-foot setback, the requirement for recreational water, this <br />house would line up with his neighbor's house. <br /> <br />Commissioner Johnson asked about the rest of the homes around the lake. He noted that in the <br />past if the setbacks for homes are at 100 feet and 80 feet, you could consider a setback distance <br />between that range. <br /> <br />Mr. Canner presented a topography map and pointed out the subject site and other homes around <br />the lake. He noted the other homes are about 50 feet from the lake and most of those lots are not <br />wooded. <br /> <br />Commissioner Johnson stated that the Planning Commission cannot guarantee a variance would <br />be approved since that would be considered by the Board of Adjustment. He stated he typically <br />thinks the setback is required to protect the neighbors and pristine waterway from the impact of <br />the house, which are not issues in this case. <br /> <br />Community Development Director Frolik stated that staff would typically prefer to support the <br />consideration of a setback variance from the ordinary high water mark rather than to not obtain <br />the Anoka County requested right-of-way. <br /> <br />Chairperson Nixt noted a variance is not under consideration tonight and asked if a <br />recommendation should be made on the sketch plan with the variance being addressed by the <br />Board of Adjustment at their next meeting.
