Chairperson Nixt stated the other issues they looked at were in the area of the pedestrian path and <br />the applicant thinks it is reasonable to correct these. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Kociscak, to recommend to the City <br />Council that they grant site plan approval contingent upon the provisions of City Staff letter <br />dated September 27, 2002. In addition the recommendation for approval is contingent upon <br />obtaining a WMO permit, placing all sewer pipes within dedicated easements, and making minor <br />changes to the grading plan concerning standing water. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Kociscak, Brauer, and Reeve. <br />Voting No: None. Absent: Commissioners Johnson and Watson. <br /> <br />Case #7: <br /> <br />Request to Rezone Certain Property from B-1 Business to R-2 Medium <br />Density Residential; Case of Turtle Moon, Inc. <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 8:07 p.m. in <br />order to reconvened the public hearing. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt reopened the public hearing at 8:07 p.m. <br /> <br />Presentation <br /> <br />Associate Planner Wald stated the City received an application from Turtle Moon Inc. <br />requesting the City rezone a portion of the Rivenwick 3rd Addition project area from B-1 <br />Business to R-2 Medium Density Residential. The applicant is proposing to develop 112 <br />townhouse units on approximately 19 acres located north of the existing Rivenwick residential <br />development. The project area is zoned a combination of R-2 Medium Residential and B-1 <br />Business. The proposed Rivenwick 3rd Addition contains Outlot D and Outlot E, which are <br />platted lots that were anticipated to serve as the future alignment of Riverdale Drive when the <br />area developed. Due to the configuration of the proposed townhouse development, Riverdale <br />Drive has been shifted to the north ranging from 40 feet to 90 feet. The total area to be rezoned <br />is approximately 1.82 acres in size. Property located south of the platted outlots (Outlot D and <br />E) is zoned R-2 Medium Density Residential and north of the platted outlots is zoned B-1 <br />Business. The Comprehensive Plan designates the area south of Riverdale Drive as medium <br />density residential development. North of the outlots is designated as Mixed-Use development. <br />The property proposing to be rezoned from B-1 Business to R-2 Medium Density Residential <br />complies with the Comprehensive Plan. City Staff recommends approval of the rezoning. <br /> <br />Chairperson Nixt stated the reason they are doing the rezoning is because they realigned <br />Riverdale. <br /> <br />Commissioner Kociscak asked where they realigned it. <br /> <br />Planning Commission/October 10, 2002 <br /> Page 5 of 20 <br /> <br /> <br />
