<br />Motion by Commissioner Jeffrey, seconded by Commissioner Watson, to close the public <br />hearing. <br /> <br />Motion Carricd. Voting Yes: Acting Chairperson Johnson, Commissioners Jeffrey, Watson, <br />Brauer, and Shepherd. Voting No: None. Absent: Chairperson Nixt and Commissioner Van <br />Scoy. <br /> <br />The public hearing closed at 7:50 p.m. <br /> <br />Commission Business <br /> <br />Acting Chairperson Johnson called the regular meeting of the Planning Commission back to <br />order at 7:50 p.m. <br /> <br />Acting Chairpcrson Johnson thought the modification to the existing Conditional Use Permit was <br />appropriate. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Jeffrey, to recommend that City <br />Council adopt Findings of Fact relating to the request for an amended Conditional Use Permit to <br />allow an accessory apartment in a single family structure in the R-l Residential - Rural <br />Developing District. <br /> <br />Commissioner Brauer stated he really does not have a problem with this but it is a rather <br />significant change. He stated it was hard deciding on this issue. He noted he had a lot of <br />problems amending this so it is not owner occupied. <br /> <br />Acting Chairperson Johnson stated he also was hesitant about this but has been reassured by the <br />public hearing that this property will be maintained. <br /> <br />Ms. Geisler stated if this was a single family house, the City could not put an owner occupancy <br />requirement on this. <br /> <br />Commissioner Watson wondered what would happen if the property changed hands again. He <br />was concerned a future owner would not care for the rental unit and let it get run down. <br /> <br />Ms. Geisler stated if it is sold, they would need to come back to the City for a new rental license. <br /> <br />Acting Chairperson Johnson wondered if they could make the CUP attached to the owner instead <br />of the parcel. <br /> <br />Commissioner Shepherd stated this bothered her because it seemed like they were making the <br />decision based on the future owner. She thought they should decide based on the property. <br /> <br />Commissioner Jeffrey asked the future owners what their plans were for the property. <br /> <br />Planning Commission/October 7, 2004 <br />Page 9 of 15 <br />
