Community Development Director Frolik advised the Lower Run River Water Management <br />Organization has approved the development in a two-phase plan. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Kociscak, to close the public hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Kociscak, Van Scoy and <br />Watson. Voting No: None. Absent: Commissioners Brauer, Johnson and Reeve. <br /> <br />The public hearing closed at 7:22 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 7:22 <br />p.m. <br /> <br />Chairperson Nixt inquired if the landscaping plan was appropriate and consistent with the area. <br /> <br />Community Development Director Frolik indicated site improvements do not precipitate <br />landscaping improvements since there isn't a new building being erected. <br /> <br />Commissioner Kociscak asked if any penalties would be enforced if the first improvement was <br />not done by June 30, 2003. <br /> <br />Mr. Bialon indicated he would be posting a letter of credit with the Finance Officer of the City to <br />ensure improvements are completed on time. <br /> <br />Community Development Director Frolik indicated after June 30, 2003, Mr. Bialon would only <br />be able to use that portion of the property that has been improved. Therefore it would be up to <br />him if he wanted to complete Phase Two by that date. <br /> <br />Chairperson Nixt questioned the wording of the Resolution, indicating it doesn't specifically <br />-state only the developed portion of the property could be utilized after June 30, 2003, or that the <br />interim use permit is only valid until June 30, 2003. <br /> <br />Community Development Director Frolik advised that was the intention of the City in <br />recommending the interim use permit. <br /> <br />Chairperson Nixt directed staff to make modifications to the Resolution to clarify the use <br />allowed for each time frame, and to modify paragraph five to allow for a reduction in the <br />financial guarantee following the completion of Phase One. <br /> <br />Chairperson Nixt asked if the building was location on the portion of the property covered in the <br />interim use permit. <br /> <br />Planning Commission/December 5, 2002 <br /> Page 4 of 7 <br /> <br /> <br />
