Staff has prepared the attached agreement and it has been sent to <br />the Developer but we have not heard from them yet. <br />Another possibly longer term solution would be the KIH property located northwest of the Public <br />Works campus. Acquisition of the KIH property was discussed at the August 10, 2004 Council <br />meeting. The advantage of this location would be the close proximity to RTC and the Pubic <br />Works campus. This would ensure a short haul and eliminate noise concerns because of the <br />distance from any residential areas. The issues with security and equipment use could be <br />addressed in the overall layout of Public Works, therefore eliminating the additional cost of those <br />items at a satellite location. <br />Motion to recommend that the City Council finalize the right-of-way agreement with RTC for <br />2004/2005 snow storage on Outlot GG and authorize City Staff to negotiate attached agreement. <br />Action: <br />Ratify the recommendation of the Public Works Committee. <br />Case #2 Consider Trail Completion of the T.H. #47 Trail <br />Background: <br />Staff reviewed the three parcels that are identified for completion of the trail along TH 47. The <br />City has acquired the Prokopio property, and the Miller property has been acquired by Oakwood <br />Development. Investigation of the Geving/Dargavel property indicated that the existing septic <br />system is in the easement area. Staff approached the property owner to look at some alternatives. <br />The property owner asked how soon sewer will be in this area, and staff received the impression <br />she would prefer to be bought out if possible. Oakwood Land Development was contacted to see <br />if they would revisit looking at that parcel. The second option is to take the 40 foot easement <br />from them, get them an easement over the portion of the property the septic system is on, and <br />bend the trail around that, and to deal with it at the time the property gets redeveloped or the <br />highway comes closer. The third option was to put in a pump for them and discharge it to the <br />sanitary sewer that is about 400 to 500 feet away. <br />It was noted that there are two issues before the Committee. The first is to give staff direction on <br />the property at 15910 and the second is to give staff direction on the triangular piece of property. <br />City Engineer Jankowski advised he would recommend purchasing the entire 40 feet of easement <br />at 15910, and offer to give the property owner a temporary drainage and utility for their septic <br />system until it is no longer in use. The consensus of the Committee was to wait and determine <br />what happens with development for the easement at 15910. <br />It was explained that there is a triangular piece at 16151 on the south side of Elmcrest Park that <br />staff thought was part of the Elmcrest purchase, but is actually owned by the property to the <br />west, that the City will need to start acquiring. Staff would recommend the Committee <br />recommend the City Council authorize staff to receive appraisals on this piece of property, as <br />was done with the other three parcels. <br />Motion to recommend that the City Council direct staff to obtain an appraisal for the triangular <br />piece of land north of Parcel 5801 1601h Lane. <br />
