Community Development Director Frolik distributed copies of an undated letter from Bob Lea, <br />16010 Sodium St. N.W, who is opposed to the variance. The subject line reads: Request for <br />Variance to Construct Garage, 15920 Radium St NV~. <br /> <br />Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:52 p.m. in <br />order to conduct the public hearing. <br /> <br />Citizen Input <br /> <br />Geno Ronallo, 15920 Radium Street N.W. stated the north yard has quite a few mature trees. He <br />said he would like to put the new garage in the south yard because it will function as the primary <br />garage in the future. He plans to finish the existing attached garage on the house into a family <br />room. He indicated he would rather not take down a large oak tree, thus the reason for angling <br />the garage. <br /> <br />Mr. Ronallo responded he did not want to add a culvert. He further explained that the front of <br />his property faces Radium Street, which is east. He explained he accesses the garage from 159th <br />Street. He said he will use the existing end of the driveway, and swing it around to the left of the <br />tree to the new garage. He also stated the garage would be inconvenient if placed farther back. <br /> <br />Community Development Director Frolik noted there is another 9 feet the garage could be <br />moved back. The garage would have to be moved further to the west to save the tree, but if he <br />squared it off, it would meet the standard setback requirements, but not the greater setback <br />established by the adjacent home to the west. <br /> <br />Chairperson Nixt said he sees nothing to prevent the garage from being moved back to meet the <br />setback requirement. He said there must be a justifiable base that isn't applicant-created in order <br />to grant the variance. He did not see a hardship in order to grant this variance. He said he did <br />not see where the pool interferes with the garage, because the pool can be moved. <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Kociscak, to close the public hearing. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Kociscak, Brauer, and Reeve. <br />Voting No: None. Absent: Board Members Johnson, Sweet, and Watson. <br /> <br />The public hearing closed at 7:56 p.m. <br /> <br />Board Business <br /> <br />Chairperson Nixt called the Board of Adjustment meeting back to order at 7:56 p.m. <br /> <br />Chairperson Nixt noted the Findings of Fact should be modified as follows: 8) should read "That <br />there are no special conditions..."; 9) "That the special conditions do result ..."; 10) through 15) <br />should be omitted; 16) will violate the intent; 17) will grant the Applicants. <br /> <br />Board of Adjustment/June 6, 2002 <br /> Page 9 of 15 <br /> <br /> <br />
