NORTH FORTY ADDITION TRAIL CORRIDOR <br /> By: Merland Otto <br /> <br />CASE <br /> <br />Background= <br /> <br />As you're aware, several residents of the North Forty Addition <br />attended the May Parks Commission meeting to indicate their <br />concerns regarding the proposed trail corridor within the drainage <br />and utility easement. The City Council at their May 22, 1990 <br />meeting directed staff to continue working towards an acceptable <br />solution. <br /> <br />One of the options discussed with the concerned residents was to <br />acquire additional land west of North Forty° This could normally <br />be accomplished through either the platting process or purchase. <br />Case. 2 on. the agenda.indicates that, at present, obtaining land <br />through dedication is not an option that exists under the proposed <br />subdivision. I have discussed the estimated market value with John <br />Keefe, City Assessor. His estimate of fair market value for <br />undeveloped property in this area is $2,200.00 an acre. A 75' <br />right-of-way would cost approximately $3,640 plus legal and <br />administrative costs possibly including condemnation. Such an <br />action would reduce the east lot of the proposed subdivision to <br />less than the minimum 7.5 acres required for development. <br /> <br />As an appraiser, Mr. Keefe believes that it would be extremely <br />difficult for any appraiser to arrive at a value for obtaining a <br />trail easement over the drainage and utility easement° <br /> <br />The development agreement between the City and the developer has <br />now been filed with the County. I hope to have met with the County <br />engineer and residents by the time of the June 13 meeting. <br /> <br />Commission Action: <br /> <br />None required at this time. <br /> <br /> <br />
