CASE # 2 <br /> <br />REQ,UEST FOR A CONDITIONAL USE PERMIT FOR AN OUTSIDE <br />DISPLAY/SALES AREA; CASE OF TOM KURAK <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. Tom K~ak is proposing to establish a motor vehicle sales lot at 7665 Hwy. #10 N.W. The <br />subject property-is approximately 2.2 acres in size and is zoned B-3 Highway Business. Motor <br />vehicle sales ~s a~!permitted use in the B-3 Business District. However, a conditional use permit is <br />required if a Permitted use in the B-3 District includes an outside display/sales area. Mr. Kurak is <br />proposing to:have 28 vehicles in the outside display area and has applied for a conditional use <br />permit accordingly. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Site plan <br />Proposed Findings of fact <br />Proposed conditional use permit <br /> <br />Observations: <br /> <br />City Code e~abtishes a 35 foot front yard setback for structures in the B-3 District; that section <br />also specifie!~ that there shall be no activity permitted in the front one-half of that setback. I <br />interpret this,to ~equire a 17.5 foot front yard setback for the vehicle display area. The applicant <br />has provided~for that setback. <br /> <br />The applicant is: proposing to hardsurface the driveway, customer/employee parking area and <br />vehicle display ~ea with concrete. The site plan does not indicate that these areas will be finished <br />with B-612 cOnCrete curbing in accordance with City Code requirements. <br /> <br />The applicant has not proposed any landscaping improvements for the site. <br /> <br />Recommendation: <br /> <br />I recommend approval of the request for a conditional use permit contingent upon the applicant <br />providing for concrete curbing of the paved areas and a landscaping plan. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recohm~nd that City Council adopt Findings of Fact # relating to Tom Kurak's <br />request for a conditional use permit for an outside display/sales area at 7665 Hwy. #10 <br /> <br />-and- <br /> <br />Motion to: <br />Recommend that City Council deny/approve Mr. Tom Kurak's request for a conditional <br />use p~rmit for an outside display/sales area at 6304 Hwy. #10 N.W. contingent upon <br />modifying the site plan to include concrete curbing and landscaping. <br /> <br />Review Checklist: <br />P&Z: 9/1/92 <br /> <br />Zoning Administrator <br />City Engineer <br /> <br />7 <br /> <br /> <br />
