I/

CASE

REQUEST FOR DIRECTION REGARDING A CERTAIN RURAL BUSINESS
PARCEL PROPOSED TO BE REZONED TO B-1 BUSINESS
By: Zoning Administrator Sylvia Frolik

Background:

As you may recall, when you conducted a public hearing regarding rezoning the Rural Business
properties to B-1 Business on February 2, 1993, Tom Austin approached the Commission. Tom
owns two Rural Business parcels on the south side of Hwy. #10. He is proposing to use the
southern po~rtion of both lots for residential purposes and requested that in our rezoning we rezone
the souther~n portion of his lots to R-1 Rural Residential. When we reconvened the meeting on
February 16, we neglected to address his request in our case discussion, Therefore, before I send
the rezoning ordinance to Council, I am seeking your direction.

Observations:

As you will note from the enclosure, rezoning the southern portion of Mr. Austin's lots to R-1
Rural Residential would be spot-zoning.

The City Council has also allocated $1 1,0130 to do a land use update this year.
Recommendation:

City Staff recommends denial of the request for residential zoning at this time and that the zoning
configuratioia in this particular area be addressed in the land use update.

Commission Action:

Motion to:
Direct City Staff to notify Tom Austin that the request for residential zoning is denied and
that particular attention will be given to this area when the City performs its land use
update.

Review Checklist:

City Administrator
Zoning Adminisn:ator

P&Z: 3/2/93
