CASE <br /> <br />REQUEST FOR <br /> <br /> SKETCH PLAN APPROVAL OF GUY ADDITION, A MINOR <br />SUBDIVISION; CASE OF NEIL GUY TRUST <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Elliott Knetsch, representing the Neil Guy Trust, has applied for a minor subdivision to plat the <br />Guy property on Hwy. #10 into 4 commercial lots. <br /> <br />Observations: <br /> <br />Ail of the lots meet the minimum size and dimension requirements for the B-3 Highway Business <br />District. <br /> <br />The major concern with this plat are the two accesses onto Hwy. #10. The review and <br />recommendations of Mn/DOT have been solicited and any plat approval should be contingent upon <br />compliance with those recommendations. City Staff is also recommending that a 60 foot drainage <br />and utility easement be dedicated along the northern boundary of the plat for future development as <br />a service road in the event Mn/DOT purchases access rights onto Hwy. #10. <br /> <br />An additional concern is the easternmost building which is only one foot from the common <br />property line with the parcel to the east. This is a non-conforming situation and Staff is <br />recommending that no variance to the side yard setback be granted with the plat. The result of this <br />action is that if the building ever goes vacant for six consecutive months or if it is damaged in an <br />amount equal to or exceeding 50% of its market value, it may not be re-used or reconstructed <br />unless it is brought up to code. <br /> <br />Park dedication wilI consist of a cash payment. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Proposed subdivision <br />Site plan indicating location of existing buildings <br />City Staff review letter dated June 29, 1994 <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the subdivision contingent upon compliance with City Staff <br />review letter and Mn/DOT recommendations for accesses onto Hwy. #10. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recommend that City Council grant final plat approval to Guy Addition contingent upon <br />compliance with City Staff review letter dated June 29, 1994 and recommendations of <br />Mn/DOT. <br /> <br />Review Checklist: City Engineer <br />PC: 7/5/94 <br /> <br /> <br />
