Case/ti 7:

Approve Change Order to Glen iRehbein Companies for Sunwood Drive NW
Storm Sewer Additions

Assistant Public Works Director Olson explained this project was authorized for construction of
MSA streets in Ramsey Town Center. The ~WOrk includes extension of trunk storm sewer
through the Ramsey Town Center Project. The stOrm sewer installed in this project connects to
developer installed utilities north and south of SunWood Drive. The developer requested revision
of the trunk storm sewer system to ~accommodatethe needs of the purchaser of the parcel located
in the southwest quadrant of Sunwood Drive and Zeolite Street. A large regional pond was
located on this site in the final Plat documentS: The purchaser requested that the pond size be
reduced to provide more developable space on this site. He explained the RTC design group
submitted a revised design to stafffor review, which incorporated redirecting some storm water
from the southwest pond to other regional ponds onsite. The changes do not affect the rate o£
discharge from the site to the Mississippi ~Ver. The Lower Rum River Water Management
Organization has reviewed the proposed changes and found they were acceptable.

Assistant Public Works Director Olson advised the changes to the regional storm sewer system
require increasing the size of some of the pipes installed under Sunwood Drive and relocation of
some storm sewer structures. These modifleati°ns are in the project area covered by this
contract; however they do not improve the function of the MSA street so the developer was
requested to cover the cost. RTC, LLC has submitted a letter indicating they will reimburse the
City for the cost of the storm sewer changes in this 'change order.

Motion by Councilmember Elvig, secondedby Councilmember Cook, to approve Change Order
#4 to Improvement Project #03-29 in the amount of $79,083.30 and adopt attached Resolution
#04-11-342 accepting Change order #4 to improvement project #03-29, MSA streets in Ramsey
Town Center.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Kurak, Pearson, and
Strommen. Voting No: None. Absent: CouncilmemberZimmerman.

Case ltl 8:

Consider Ramsey Town Center Park and Trail Agreement

Moved up in the agenda to be acted on as Case B.

City Attorney Goodrich advised this case needs further discussion. He explained paragraph 5.2
of the Ramsey Town Center Park and Trail Agreement requires the developer to expend a
minimum of $4,219,144.00 on the Parkland'Improvements. The developer would like to have a
little more comfort, and would like the minutes to reflect that the Council has authorized the City
Attorney to amend the language to convey more explicitly the concept that the total of the
improvements will be worth $6.2 million, but that the developer will not be required to spend
that much.

City Attorney Goodrich suggested:the following amendment to paragraph 5.2: Notwithstanding
the cost estimate total on Exhibit B, pages 5-11, the Developer is not obligated to expend said

City Council/November 9, 2004
