City Administrator Norman stated when the Master Development Agreement was developed; the <br />concept was that the benefit goes beyond the core. That concept is not out there with the <br />secondary developers, and with Shingobee Development, which is a developer in their own right. <br />The approach has been changed, in that businesses like Shingobee and the bank have their own <br />parking to pay for, but the core does not have that parking and would pay towards the parking <br />structure. He advised they do need to address some sort cfa cap. <br /> <br />Councihnember Elvig stated he does not see that someone will not walk right across the street <br />fi'om structured parking to do business. This was supposed to be blended as a single purpose. <br />He docs not think they will try to get Shingobee to pay for all of this, but a fee for parcels within <br />300 feet would be very reasonable. <br /> <br />City Administrator Norman replied he suggested this type of approach with a fee at a lower <br />percentage for businesses outside of the core, and Shingobee stated they would not agree to that. <br /> <br />Councilmember Cook stated he thinks they have to proceed with Paragraph No, 6. It sounds like <br />both sides are willing to negotiate to bring it down and make it a workable fee. That is the area <br />that will be using the ramp and they should have some money available to help with the funding. <br /> <br />Mayor Gamec commented it looks like the concept is right and the concern is with Outlots C and <br />D. There may be some kind of compromise that would work with this. <br /> <br />Mr. Lasher indicated there is a parking analysis of what parking the buildings would use. These <br />are uses that are currently properties within the Development Agreement. He advised if the <br />Council does not hold to the high-density development and the businesses start building their <br />own parking lots, it could turn into a strip mall development, and all bets are off. <br /> <br />Mr. Bray suggested one compromise that could be posed to Shingobee Development is to include <br />Outlots A and C within the broader terms of the document, but only assess against properties that <br />rely on the parking ramp for their approved parking. <br /> <br />Coul]cilmember Elvig noted there may be a developer that would like to add more businesses <br />across fi'om the parking, and they could opt into the assessment at that time. <br /> <br />Mr. Nedegaard indicated he cannot speak for Shingobee Development, but he would think they <br />would go along with that suggestion. <br /> <br />Mr. Lasher indicated Paragraph No. 6 will move forward in its current fashion and come back to <br />the Cotmcil with a definition of areas that benefit from the parking, which may go outside of the <br />core arca. A budget will be done with the income from the existing tax base and will come back <br />for the Council's review to finalize Paragraph No. 6. He asked Mr. Bray if they can legally pull <br />Paragraph No. 6 out of the amendment, to be acted on separately. <br /> <br />Mr. Bray indicated he would not advise separating Paragraph No. 6 from the amendment. <br /> <br />City Council Special Work Session/November 9, 2004 <br /> Page 6 of 11 <br /> <br /> <br />
