Mr. Lasher advised this will need to be addressed at an upcoming worksession. <br /> <br />Mr. Nedegaard stated addressing this at a future worksession would stop the Coburn's closing <br />and put it off.' until next spring. <br /> <br />Mr. Bray stated it will take several weeks to have the document drafted and negotiated. <br /> <br />Mr. Martinson stated a study was done and the City's expert defined the core development area. <br /> <br />Mr. Lasher stated the study that was done did not define the core area as the only benefiting area. <br />There is still benefit outside the core area from the parking lots, which is proven in the parking <br />study. Thc reason they are showing the core area now is that they thought that would be the only <br />area that could be approved. He agrees with the Council as to including other areas as well. He <br />explained he thi~s Shingobee's basic position was they saw no benefit from the structured <br />parking roi' the grocery store. However, there are other parcels that could show benefit. He <br />assures the Council that the benefiting area is larger than the core, and it would not reach to <br />Coburn's. <br /> <br />Councilmember Kurak questioned how Paragraph No. 6 can be addressed tonight so the closing <br />cab occult. <br /> <br />Mr. Lasher replied the term benefit would be one way to move forward; if they can show benefit <br />fi'om parking for areas within the core plus surrounding edges. <br /> <br />Mr. Bray indicated the concept being discussed is to broaden the benefits of the core area to <br />include properties that are potentially benefiting, but limiting the City's authority to levy charges <br />within that core area to properties that are actually in fact benefiting. A question would be how <br />to define that benefit. <br /> <br />Councihnember Kurak noted this would be known when the parking requirements are addressed <br />at Planning and Zoning. <br /> <br />Mr. Lasher indicated the benefit analysis was based on the City's current zoning and parking <br />requirements. That document can be provided and will show the benefits to the surrounding <br />parties, and goes well out of the core. <br /> <br />Councilmember Kurak asked if there are any zoning limitations in the TC zoning that disallows <br />higher density than what wotdd have been proposed with just parking lots. <br /> <br />Assistant Community Development Director Trudgeon replied they could cover the whole area <br />with buildings they wanted to do that. <br /> <br />Mr. Lasher inquired if Shingobee would agree to the language of showing benefit to the parking <br />for parcels outside of the core area. <br /> <br />City Council Special Work Session/November 9, 2004 <br /> Page 7 of 11 <br /> <br /> <br />
