Councihnember Anderson replied that the statement is not true and should be corrected. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Hendriksen, to amend <br />finding #10 in Resolution #01-12-424 to read "will not". <br /> <br />Motion carried. Voting No: None. <br /> <br />Motion by Councihnember Anderson, seconded by Councilmember Kurak, to adopt Ordinance <br />#02-002 to rezone certain property in Section 14 from R-1 Rural Residential to R-1 Urban <br /> <br />Residential. <br /> <br />A roll call vote was performed by <br /> <br />Councihnember Kurak aye <br />Councilmember Anderson aye <br />Councihnember Hendriksen aye <br />Councihnember Zimmerman aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #4: <br /> <br />the Recording Secretary: <br /> <br />Request for Preliminary Plat Approval of River Pines 5th Addition; Case of <br />Oakwood Land Development, Inc. <br /> <br />Community Development Director Frolik stated that Oakwood Land Development has submitted <br />a preliminary plat to the City for a subdivision to be named River Pines 5"' Addition. The <br />property is located on the west side of T.H. #47, immediately north of the existing Apple <br />Ridge/River Pines neighborhood. At the time of application, the property was located outside <br />the boundaries of the Metropolitan Urban Service Area (MUSA) and was zoned R-1 Rural <br />Residential. At their regular meeting in September, the Planning Commission recommended that <br />City Council approve an amendment to the Comprehensive Plan to expand the MUSA boundary <br />to include the subject property. They also recommended that the City Council rezone the <br />property to R-1 Urban Residential to facilitate development of the property at urban standards. <br />The City Council introduced the rezoning ordinance on December 11, 2001, and approved the <br />2001 Comprehensive Plan on December 18, 2001. The 2001 Comprehensive Plan expands the <br />MUSA boundary to include the subject property. The plat area is 9.7 acres. The subdivision is <br />proposing to plat 17 new, single-family parcels and one existing homestead for a total of 18 <br />single-family lots. Net density (exclusive of Highway #47 right-of-way) has been established at <br />1.9 units per acre. The 18 lots will receive public access from the extension of 158th Lane into <br />the plat fi'oln River Pines 2''a Addition to the west. Currently, 158th Lane dead ends on the west <br />boundary of the proposed plat and this is a public safety concern since the length of this dead end <br />is greater than 600 feet.
