Chairperson Nixt indicated the drainage should not affect the Regency pond, and may even help <br />with drainage for that area. <br /> <br />Associate Planner Geisler noted there have been detailed studies done on drainage for the area. <br />She stated if Ms. Peterson contacts staff they can provide her with copies of the plan. <br /> <br />Chairperson Nixt stated he feels it is the best alignment and plan for this area. <br /> <br />Board Member Brauer agreed, stating it was very imaginative to put the pond in the way they did. <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Brauer to close the public hearing at <br />7:08 p.m. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Brauer, Shepherd, and Watson. <br />Voting No: None. Absent: Board Members Jeffrey, Johnson and Van Scoy. <br /> <br />Commission Input <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Watson to adopt Resolution #04-11- <br />343 adopting Findings of Facts favorable to the applicant relating to a request for a variance to <br />pavement setback requirements from public street right-of-way on Outlot A, Regency Pond. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Watson, Brauer, and Shepherd. <br />Voting No: None. Absent: Board Members Jeffrey, Johnson and Van Scoy. <br /> <br />Motion by Chairperson Nixt, seconded by Board Member Watson to approve the request for a <br />variance to pavement setback requirements for the property knows as Outlot A, Regency Pond <br />based on the Findings of Fact and adopt Resolution #04-11-344 declaring terms of same. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Watson, Brauer, and Shepherd. <br />Voting No: None. Absent: Board Members Jeffrey, Johnson and Van Scoy. <br /> <br />Case #2 <br /> <br />Request for a Variance to Bufferyard Requirements in the E-1 Employment <br />District; Case of TSM Development, Inc. <br /> <br />Presentation <br /> <br />Associate Planner Geisler reported that the E-1 Employment District requires a 60-foot <br />bufferyard between parcels zoned E-1 and parcels zoned R-l. She stated the site plan for CNP <br />storage is showing an adequate bufferyard along its eastern boundary, but only a 30-foot <br />bufferyard along its northern boundary. <br /> <br />Associate Planner Geisler stated that Staff would also note that mini-storage is a less intensive <br />use than could be constructed on the site, such as a manufacturing facility or truck terminals.
