Case/t3 Request for a Comprehensive Plan Amendment; Case of Brightkeys, Inc. <br /> <br />Presentation <br /> <br />Associate Planner Geisler advised that Brightkeys, Inc. has submitted a request for a <br />Comprehensive Plan Amendment to change a portion of their land from Medium-Density <br />Residential to Mixed-Use in order to allow for housing of similar density to that of the Town <br />Center. She indicated this Comprehensive Plan Amendment is being considered along with the <br />sketch plan for Town Center Gardens 3rd Addition. <br /> <br />Associate Planner Geisler indicated the Applicant has submitted a revised sketch plan based on <br />input received at the August 5, 2004 Planning Commission meeting. She noted major changes to <br />the sketch plan include the addition of 21 single-family lots in the northern portion of the plat. <br /> <br />Associate Planner Geisler stated that Brightkeys is seeking a Comprehensive Plan Amendment <br />for the southwestern portion of the plant to change from Medium-Density Residential to Mixed <br />Use. She indicated the rationale for their request is to accommodate shifting some of the density <br />from the northern part of the site to the south, and also to complement the Town Center <br />development immediately adjacent west of the property, as well as south of Bunker Lake <br />Boulevard. <br /> <br />Associate Planner Geisler stated that because of the revisions that have been made to the Town <br />Center Gardens 3rd Addition sketch plan, and the current and planned land use designation on <br />adjacent properties, Staff recommends approval of the Comprehensive Plan Amendment to <br />change the subject property's Land Use designation from Medium Density Residential to Mixed <br />Use. <br /> <br />Public Input <br /> <br />Jamie Sharp, 7346, 7350 149tl~ Avenue and 7362 149th Avenue indicated he was at the August <br />meeting, and at that time the Planning Commission said the applicant had to talk to all the <br />neighbors, but he did not. He stated this plan would put a road through a building on his property <br />that is only six years old. He indicated he feels he is being railroaded out of his property, and he <br />will take a gigantic financial hit. <br /> <br />Mr. Sharp stated it has always been his intention to develop, and this would be reducing the <br />number of units he could have when he should be able to get the same number of units as Mr. <br />Dommer did at seven units per acre. <br /> <br />Chairperson Nixt noted this property is zoned PUD now. <br /> <br />Mr. Sharp stated it has been approved by the Metropolitan Council to hook up to sewer and <br />therefore he could break out of the PUD. <br /> <br />Planning Commission/November 4, 2004 <br /> Page 5 of 13 <br /> <br /> <br />
