Councilmember Anderson inquired if there was anything the developer could do regarding the <br />lots along the pond. <br /> <br />Mr. Black stated that he would be willing to compromise if the process is not delayed, but noted <br />that he would not be willing to change the street alignment, the open space, or the depth of the <br />lots. He explained that Lots 1, 2, 3, and 12 through 19 abut the pond and he would be willing to <br />remove two of those lots. In regards to tree preservation there is a specific plan in place for the <br />development and grading will be completed in phases to assist with the tree preservation process. <br />He also noted that he has committed to do some reforestation. <br /> <br />Councilmember Anderson inquired if Mr. Black is willing to put the reforestation agreement in <br />writing. <br /> <br />Mr. Black replied yes. He stated that he would commit to not start grading until phase I of the <br />biological study is completed. He indicated that he would look for approval to begin clearing for <br />road right of way and staking the center line to allow for removal of the trees within the center <br />line. He also stated that if there is a real concern with Blandings Turtles in the City of Ramsey <br />then he felt that all development should be required to follow the same standards. <br /> <br />Councilmember Hendriksen stated that when certain Councilmembers adopt a Comprehensive <br />Plan that doubles the permitted density he does not want those Councilmembers to state that they <br />have to approve the development. He stated that he wished those Councilmembers had the same <br />level of concern for the citizens of Ramsey as they do for the Blandings Turtles. <br /> <br />City Attorney Goodrich recommended that if the Council is inclined to grant preliminary plat <br />approval he would recommend that the motion include the following language: "..approve <br />preliminary plat, which reduces two lots in Block 2 and Block 3,.." and "..in addition the <br />developer shall not be permitted to grade within the plat area except in the proposed right of <br />ways prior to Phase I of the biological survey is completed, after which time the developer shall <br />comply with the requirements of the said biological survey." <br /> <br />Fredrick, 14569 Iodine Street NW, Ramsey, stated that as someone with a 2 ½ year old he is very <br />concerned with the additional traffic. He felt that there were too many kids along Iodine Street to <br />take the issue for granted. <br /> <br />Motion by Councihnember Kurak, seconded by Councilmember Anderson, to adopt Resolution <br />#02-02-041 approving the preliminary plat, which reduces two lots in Block 2 and Block 3, <br />subject to the City staff review letter dated December 28, 2001, the rezoning of the parcel to R-I, <br />R-3U, and Multiple Residential, and completion of a biological survey to determine the existence <br />of Blandings Turtles on the property. In addition, the developer shall not be permitted to grade <br />within the plat area except in the proposed right of ways prior to Phase I of the biological survey <br />being completed, after which time the developer shall comply with the requirements of the said <br />biological survey. <br /> <br />City Council/February 12, 2002 <br /> Page 23 of 33 <br /> <br /> <br />
