, Soils Ordinance <br /> <br /> ORDINANCE NO. 77- <br />CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br /> <br />AN ORDINANCE ESTABLISHING MINIMUM REOUIREMENTS FOR THE INCORPORATION <br />AND RESERVATION OF ADEQUATE AREAS OF SOILS CONDUCIVE TO SE~VAGE <br />DISPOSAL FROM SEPTIC SYSTEMS INTO LOTS OR PARCELS CREATED BY THE <br />SUBDIVISION OF LAND. <br /> <br />The City Council of the City of Ramsey does hereby ordain: <br /> <br />SECTION I - PURPOSES AND FINDINGS <br /> <br /> 1.1 The City of Ramsey determines that in ~reas not served by <br />sanitary sewer, the effluent from septic tanks 'shall be disposed of by <br />soil absorption in properly Constructed and effectively operating <br />absorption systems. <br /> <br /> 1.2 The City determines that protection of the public health, <br />safety and general welfare including the protection of natural resources <br />from impairment, pollution and destruction with which it is charged by <br />Minn. Stat~ 1973 Section 116 B.01 are advanced by permitting soil <br />absorption systems only where soil permeability, surface slope, freedom <br />from flooding and distance from groundwater ensure reasonable absorption <br />without pollution of waters, such lands hereinafter being described as <br />Class I lands. <br /> <br />1.3 The City finds that lands within it have unfavorable <br />'characteristics for soil absorption systems; such lands hereinafter being <br /> described as Class II, Iit, IV and V lands. <br /> <br /> 1.4 The City adopts the standard requirement that sufficient area <br />of Class I land be available within each lot or parcel for the construction <br />of an adequately sized soil absorption system and the reconstruction or <br />duplication of the soil absorption or final disposal unit of that system. <br />In no case shall the area of contiguous Class I land available on each <br />lot be less than as follows: <br /> <br />1990 Urban Area <br />Transitional Area <br />Rural Area <br /> <br />50%-0f lot area <br />25% of lot area <br />25% of lot area <br /> <br />Ail areas shall be exclusive of public rights of way, including <br />publicly dedicated easements. <br /> <br /> 1.5 The City adopts the Anoka County Soil Survey, '1977 (Soil Survey) <br />and supplemental operational soil surveys as its official soil survey <br />and makes it a part of this ordinance, and a copy of which is on file <br />with the City Clerk. The Soil Survey is a guide to establishing land <br />classifications as defined herein. Land areas mapped and described in <br />the Soil Survey as being acceptable for soil absorption systems does not <br />constitute an implied or express warranty that such land zs in fact <br />usable for this purpose. <br /> <br /> <br />
