Voting Yes' Mayor Gamee, and Councilmember Kurak. <br />Councilmembers Anderson, Hendriksen and Zimmerman. <br /> <br />Voting No: <br /> <br />Councilmember Kurak left the meeting. <br /> <br />3) Contract Zoning <br /> <br />Councilmember Zimmerman stated that he would like the Council to adopt the policy used by <br />Andover, which would allow a property to be rezoned based on a specific development plan and <br />if the development does not proceed, then the rezoning does not occur. <br /> <br />City Administrator Norman stated that staff has reviewed the language included in the Andover <br />Development Policy and staff is willing to include that language in the City's development <br />agreements. <br /> <br />Councilmember Hendriksen stated that he did not understand why they have been unable to <br />move forward with adopting such a policy. Currently the City has nothing in place that can <br />prevent things fi'om occurring on a property once it is rezoned. He requested that staff get candid <br />as to what the objections are to the policy so that they can move forward. <br /> <br />The Council discussed at some length as to when the issue was first brought up for discussion. <br /> <br />City Administrator Norman stated that if the Council directs staff to implement the policy, staff <br />would do so. <br /> <br />Counci hnember Hendriksen inquired if staff had any objections to the policy. <br /> <br />City Administrator Norman replied no. <br /> <br />Councihnember Zimmerman stated that the fear some Councilmembers have when they rezone <br />property is that once the property is rezoned and that particular development fails to go forward <br />another developer might have something else in mind for the property that might not be in the <br />best interest of the City. With contract rezoning, a plan is presented and the zoning is contingent <br />on developing what was presented. <br /> <br />City Administrator Norman noted that staff would bring the policy forward for Council <br />consideration. <br /> <br />4) Andover Development Policy <br /> <br />City Administrator Norman presented the Council with Andover's Development policy noting <br />that Andover constructs all City roads and City services for the development. He explained that <br />the City of Andover takes out bonds for the roads and City services and the developer is required <br />to pay the City back over a period of time.
