Council Review: Intial Determination. Within 10 working <br />days of receipt by the Council of a proposed comprehensive <br />plan amendment and a complete information submission, the <br />Chairman shall make an initial determination and notify the <br />governmental unit whether the proposed amendment has a <br />potential impact on any of the metropolitan systems plans. <br />Failure of the Chairman to mail notification via "certified <br />mail" of his initial determination within 10 working days <br />of receipt of the proposed a~endment shall be deemed to <br />constitute a finding of no potential impact upon any of the <br />metropolitan systems plans. <br /> <br />Council Review for System Impact. If the Chairman <br />initially determines that a proposed local plan amendment <br />has potential impact on any of the metropolitan system <br />plans, the Chairman shall mail a notice to the local <br />governmental unit within 10 working days of receipt of the <br />proposed amendment that the amendment has potential impact <br />and may not be put into effect until Council review is <br />completed. ?he Council shall have 90 days from receipt of <br />the proposed amendment in which to complete its review, <br />pursuant to Minn. Stat. 473.175, Subd. 1. Failure of the <br />Council to act within 90 days of receipt of the proposed <br />comprehensive plan amendment shall be deemed to constitute <br />a finding of no substantial impact on or no substantial <br />departure from metropolitan systems plans. <br /> <br />Council Review and Comment. If the Chairman initially <br />determines that a proposed comprehensive plan amendment has <br />no potential impact upon any of the metropolitan systems <br />plans, the Chairman's notice to the local governmental unit <br />shall state whether the Council intends to review and <br />comment on the proposed amendment and shall also state that <br />the amendment may be placed into effect at any time. The <br />Council shall have 60 days from receipt of the proposed <br />amendment to review and comment upon the apparent <br />consistency of the proposed amendment with other adopted <br />chapters of the Metropolitan Development Guide pursuant to <br />Minn. Stat. 473.175, Subd. 1. The review comments shall be <br />transmitted to the local governmental unit regardless of <br />whether that unit has finally approved the proposed <br />amendment. The Council may waive its review and comment <br />authority in the initial determination at No. 3 above· <br /> <br />Criteria for Determining Potential Systems Impact. The <br />Council shall utilize the following criteria in making its <br />initial determination pursuant to No. 3 above. <br /> <br />Whether the proposed amendment may result in a change <br />in the timing, staging, capacity, or service area of <br />the approved local facilities in the sewer policy plan <br />or comprehensive sewer plan (CSP) for which the Metro- <br />politan Waste Control Commission may require a CSP <br />amendment; <br /> <br />r3 <br /> <br /> <br />
