Councilmember Hendrikgen gtated that part of the jugtifieation for the $150,000 loan at Sunfish
Commons had to do with Star Exhibits coming to the City.

City Attorney Goodrich noted that the loan transaction with Sunfish Commons has not yet
occurred.

Councihnember Hendriksen suggested that maybe they should reconsider granting the loan. He
also inquired if the plat should be changed since Star Exhibits is no longer going to be on the
property.

City Attorney Goodrich noted that the property can be subdivided at a future date

Mayor Gamec stated that Star Exhibits made a lot of commitments to the City and should be held
responsible for any costs the City incurred.

Councihnember Zimmerman stated that due to the economic conditions he felt that the City
should be seeking smaller companies.

City Attorney Goodrich inquired if staff should proceed with the loan transaction for Sunfish
Commons.

Councilmember Kurak stated that she would not feel comfortable backing out of an agreement
the Council already approved.

Councihnember Hendriksen felt that it would make sense to bring the Star Exhibit issue back on
the next Council agenda and include the Sunfish Commons issue as well since bringing Star
Exhibits was the main justification for offering the loan.

Mayor Gamec stated that he would like the City Attorney to begin working on any legal recourse
the City might have with Star Exhibits right away.

City Attorney Goodrich stated that he will have to research what types of damages and the course
of action, but he will not be able to bring that information forward by the next Council meeting.

Mayor Gamec noted that he could call a special meeting if necessary.

City Attorney Goodrich inquired if staff should proceed with Sunfish Commons transaction.
Mayor Gamec and Councilmember Kurak felt that they should proceed with the transaction.

Councilmelnber Hendriksen stated that he was unsure if the loan was an "award" for bringing
Star Exhibits to the City. He inquired if that was the only justification for approving the loan.

City Council/April 23, 2002
