AMENDMENT TO ELOFSON EASEMENT AGREEMENT <br /> FRONT STREET PROJECT <br /> By: Peter Raatikka, City Engineer <br /> <br />Case # 5 <br /> <br />Background: <br /> <br />Last spring the City entered into an easement agreement with Ralph and <br />Doris Elofson, which required the city to provide certain benefits as <br />full payments for property rights. <br /> <br />one of the benefits was to provide commercial accesses onto Front <br />Street and Sunfish Lake Boulevard in accordance with the land owners <br />development plan. The Elofson's do not have an approved development <br />plan and we are currently constructing Front Street. Therefore, as <br />indicated in my letter of October 31, 1988 to Mr. Randy Elofson, <br />construction of the commercial accesses at the time would be <br />premature. To delete these entrances an amendment to the agreement <br />would have to be prepared and the City would have to pay the Elofsons <br />$4,890 in lieu of constructing the entrances. <br /> <br />Enclosed is a copy of my letter to Randy Elofson dated October 31, <br />1988 discussing the amendment. <br /> <br />Recommendation: <br /> <br />I would recommend that the city Council pass a motion directing the <br />City Attorney to prepare an amendment to the agreement deleting the <br />construction of the commercial entrances by the City in exchange for a <br />$4,890 payment to the Elofsons and authorize the Mayor and City <br />Administrator to sign the amendment. <br /> <br />Council Action: <br /> <br />Motion to direct the City Attorney to prepare an amendment to the <br />E!ofson Easement Agreement deleting the construction of the commercial <br />entrances by the City in exchange for a $4,890 payment to the Elofsons <br />and authorize the Mayor and city Administrator to sign the amendment. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Comm.
