.

.

.

City Attorney Goodrich replied that the Council can make the approval contingent upon the
resolution of that issue.

Councilmember Anderson stated that a reference was made regarding an interceptor coming
through and she was not aware of an interceptor.

Principal Engineer Olson explained that the City hired Hakanson Anderson to do a study on the
existing infrastructure and develop a plan for the area. The sewer is located behind the school
and what they have done is come up with a preferred alignment that would be extended for the
future. The developer was given options as to what he can do in the meantime. What they have
asked for is that the 100- foot corridor be preserved for the trunk line in the future. The developer
has preliminarily discussed the fact that the City has asked them to extend the deep sewer line
and because of that, they have requested some latitude as it relates to the depth of the sewer line
just in case there is a change in alignment. He would also ask that the developer work directly
with City staff to assure that the benchmark system is identical.

Councilmember Anderson inquired if there was another interceptor coming from another area.

Principal Engineer Olson replied no, he explained that they were planning for future trunk
extension, it would not be another interceptor.

Motion by Councilmember Kurak, seconded by Councilmember Hendriksen, to approve the
preliminary plat of Wildlife Sanctuary 2nd Addition contingent upon compliance with City staff
review letter dated April 26, 2002, revised May 24, 2002, the rezoning of the property to R-l
Urban, the finding of a positive outlet and working with staff on the 100 foot corridor, the line
being installed appropriately, and the funding of those items acceptable to the City Council.

Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Hendriksen,
Anderson, and Zimmerman. He
stated that the reason for the stubbed street is because of his driveway and he already has people
accessing his driveway from the development to the north of him. On the north side he has eight
neighbors and will now have the same to the south, but the way the north side was developed
upset him greatly. He explained that when the property was developed on the north side they
infringed up to 35 feet on his property, knocked down his fence and some of his trees, as well as
graded a portion of his property. When he brought the attention to the developer, a IS-foot
undisturbed area along the property was agreed to, but that did not last. He requested that the

City Council/May 28, 2002
