City Attorney Goodrich replied if the funds need to be reimbursed and the project does not <br />procced, that should coincide with the RALF fund purchases. He indicated he will get this <br />information to the Council. <br /> <br />Counci hnember Elvig inquired about differing values on the properties in relation to the pipe. <br /> <br />City Attomcy Goodrich replied with regard to this particular project, this is a storm sewer <br />project that will be going through to serve other properties. It will not likely change a lot of the <br />value of those properties. <br /> <br />Councilmember Elvig indicated there was also a question raised as to if there is a way to split <br />the properties, with the properties currently utilizing the pipe being created as a new district. <br /> <br />Councihnember Kurak questioned who. will be paying for the ongoing fees for the drainage <br />pipe. <br /> <br />City Attorney Goodrich replied typically these fees are assessed to the owner of the property, <br />but this determination will depend on situations such as the Met Council having higher priority <br />than the City. <br /> <br />Councilmember Kurak commented her understanding is the project was ordered and paid for <br />through bonds. <br /> <br />City Attorney Goodrich replied that was the situation with the first phase, but it is not the <br />situation with the property that the City is about to acquire. <br /> <br />Councilmember Cook asked if the parties selling the property are being compensated in the <br />sales price for the fact that they were levied against for the pipe. <br /> <br />City Administrator Norman replied these properties were assessed for a two-year period. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Cook, to ratify the <br />recommendation of the Finance Committee for Case No. 1 and adopt Resolution #04-12-369 <br />Adopting the 2004, Payable 2005 Municipal Tax Levy and adopt Resolution #04-12-370 <br />Adopting the 2005 City of Ramsey General Fund Operating Budget. <br /> <br />Motion carried. Voting Yes: Mayor Pro Tern Zimmerman, Councilmembers Elvig, Cook, <br />Kurak, and Pearson. Voting No: None. Absent: Mayor Gamec and Councilmember <br />Strommen. <br /> <br />2) Review and Adopt 2005 EDA & HRA Levy <br /> <br />Finance Office Lund explained at the EDA's monthly meeting on Wednesday, September 8, <br />2004, thc EDA authorized a levy of $233,306 with $200,306 as an EDA levy and $33,000 as an <br />HRA levy. Council accepted the EDA's recommendation and adopted the $233,306 at its <br /> <br />City Council/December 14, 2004 <br /> Page 9 of 33 <br /> <br /> <br />
