The City Council also instructed
several small changes be made. The changes made are covered in the memo from Loren Gordon,
the City's consultant from Hoisington Koegler Group, Inc. Under the City Charter, the
ordinance is now eligible for adoption.

Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Ordinance
#02-17 to amend the text and zoning map for the low, medium, and high density residential
districts, and the text for the Planned Unit Development district contained in Chapter 9 (Zoning
and Subdivision of Land) of City Code.

Further discussion: Councilmember Anderson stated a change had been made that dealt with all
new properties created through the subdivision process, but she thinks it is not worded correctly.
Loren Gordon, Consultant with Hoisington Koegler Group, agreed that the text does not show up
as discussed and suggested that Section 9.20.11 R-1 Residential District, Subdivision 1, Intent,
second sentence, would start: "All newly created lots through the subdivision process..."
Section 9.20.12 R-2 Residential District, Subdivision 1, Intent, second sentence, would be
revised to indicate: "All newly created lots through the subdivision process and located within
the 2020 MUSA shall be serviced by sanitary sewer and municipal water."

Amendment by Councilmember Kurak, seconded by Councilmember Anderson, to include the
revised language to Subdivision 1, Intent.

Further Discussion: Councilmember Zimmerman stated he thinks it should contain the real
definitions as well as the urbans so he does not agree with this.

Amendment carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, and Anderson.
Voting No: Councilmembers Hendriksen and Zimmerman.

A roll call vote was performed by the Recording Secretary:

Councilmember Zimmerman nay
Councilmember Kurak aye
Councilmember Anderson aye
Councilmember Hendriksen nay

City Council/June 11, 2002
