Councihnember Anderson asked if there was any way to control the blowing sand. <br /> <br />City Engineer Olson stated the developer has submitted an erosion control plan but it was very <br />difficult to control 74 acres when opening a lot on it. <br /> <br />Councihnember Anderson asked if watering would help keep the blowing sand down. <br /> <br />Mayor Gamec stated that it is a real problem with sand blowing and if water is put on this, the <br />water will dry up right away. <br /> <br />Motion by Councilmember Kurak, seconded by Mayor Gamec, to adopt Resolution #02-06-152 <br />granting final plat approval to Highlands at River Park 2''a Addition contingent upon compliance <br />with the City Staff Review Letter dated June 20, 2002, Hakanson Anderson Associates, Inc., <br />Review Letter dated June 20, 2002, and the Developer entering into a development agreement <br />with the City. <br /> <br />Further discussion: City Attorney Goodrich asked if this was a motion to adopt the resolution. <br />Mayor Gamec answered in the affirmative. Councilmember Kurak mentioned it stated the <br />developer was required to provide the City with a copy of the Lower Rum River Water <br />Management Organization permit prior to commencement of any grading. She stated that she <br />would like that added to the motion if it was not already included. City Engineer Olson stated he <br />was at the LRRWMO meeting when it was approved but they did not yet have the letter. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, and Anderson. Voting <br />No: Councilmember Hendriksen, Zimmerman. <br /> <br />Councilmember Hendriksen stated this was the portion of the plat where the gentlemen on the <br />end of Ute Street would get his ten new neighbors and he did not think that should have <br />happened. <br /> <br />Case #3: <br /> <br />Request for Final Plat Approval of The Ponds Second Addition; Case of <br />Royal Oaks Realty <br /> <br />Community Development Director Frolik noted that Royal Oaks Realty has submitted a final <br />plat for The Ponds Second Addition to develop seven single-family lots on 145th Court. The area <br />to be developed as The Ponds Second Addition is shown as Outlot B of The Ponds final plat and <br />has been referred to previously as the "peninsula." Staff recommends final plat approval of the <br />Ponds Second Addition subject to the staff review letter dated June 21, 2002, and the developer <br />entering into the development agreement as proposed. She stated at the May 14th Council <br />meeting, the Council made a motion that was approved to prohibit the removal of any trees on <br />the peninsula until a tree preservation ordinance was in place. She stated they met with the <br />developer at the site today to review the extent of their grading. She stated to restrict the grading <br />limits to the road right-of-way is not practical, they have to go beyond the road right-of-way to <br />create the slopes and back fill for behind the road. <br /> <br />City Council/June 25, 2002 <br />Page 12 of 34 <br /> <br /> <br />
