Councilmember Anderson asked if their code was applicable to the entire pond area. <br /> <br />City Attorney Goodrich stated it was. <br /> <br />Councihnember Anderson asked if the peninsula was going to be subject to the environmental <br />rules. <br /> <br />City Attorney Goodrich stated this was true and there were certain things in the development <br />agreement which the developers agreed to and they reviewed the ordinance agreement with City <br />consultants. <br /> <br />Councilmember Anderson stated the City Code calls for an environmental permit, which the City <br />has not used in that form. <br /> <br />City Attorney Goodrich stated they had granted grading and excavation permits and <br />environmental permits as a combination to the preliminary plat approval. <br /> <br />Councilmember Anderson stated she understood the outlots contained within a plat shall not be <br />exempted. <br /> <br />City Attorney Goodrich stated outlot are not exempted from anything and they were exempted <br />from more things than anything else. <br /> <br />Mr. Joe McDilda, 14321 Neon Street NW, stated he submitted a document to the Council. He <br />highlighted some of the issues regarding this site. He stated that over the course of several <br />meetings they have seen pictures of what was ended up with and what kind of development they <br />were looking forward to. He stated he agreed with Councilmembers Hendriksen and <br />Zimn~erman in stating that at some point you do have to draw a line and they need to find ways <br />to curtail it back and find out what could be done better and then move forward with that. He <br />stated with regard to the preliminary plat, he was concerned that they had a lot of vehicles in <br />place for the developer to come in and change certain things. He stated they were talking about a <br />year and what they were required to do in regard to the preliminary plat. He stated the original <br />preliminary plat was not correct when it was submitted and approved. He stated it was open for <br />the Council to decide at what point they were considering the actual preliminary plat. He stated <br />the Council should move forward and not look back. <br /> <br />Mr. Mike Ingles, 5751 - 145th Court NW, stated this would affect him the most. He stated he did <br />not understand the grading. <br /> <br />Community Development Director Frolik stated this was the original proposal and not what was <br />considered tonight.
