Case #8: <br /> <br />Request for an Appeal to the Board of Adjustment Decision Relating to a <br />Request for Variance; Geno and Laurie Ronallo <br /> <br />Community Development Director Frolik explained that Geno and Laurie Ronallo are proposing <br />to construct a garage that will encroach on the side yard setback on their property at 15920 <br />Radium St. N.W. She stated the Board of Adjustment ruled that Mr. Ronallo's case does not <br />meet the criteria for granting a variance. Additional City Code currently does not have <br />provisions for granting variances based on 'practical difficulties'. In the event Council <br />dete~rnines that there is a hardship, Staff is recommending that Mr. Ronallo adhere to a setback <br />of 35 feet, versus the 26 feet proposed. Thirty five feet is the current standard minimum. When <br />the new ordinance takes effect on July 11 for a 40-foot setback, Mr. Ronallo's request will equate <br />to a 5-foot variance, rather than a 14-foot variance. <br /> <br />Mr. Ronallo stated he wanted to angle the garage because he did not want the look of a detached <br />garage and if he did not angle the garage he would need to move the garage far enough away to <br />accommodate a tree that would be in the way of the new garage, and he did not want to remove <br />that tree. He stated this detached garage would not be a second garage; it would be the primary <br />garage because he was going to turn the existing garage into a family room. <br /> <br />Mayor Gamec asked if the garage were set at an angle, would they eliminate the existing <br />driveway. <br /> <br />Mr. Ronallo stated he would like to use the existing driveway but angle it around the existing <br />tree into the new garage. <br /> <br />Councilmember Hendriksen asked what was the logic to the 40-foot setback. <br /> <br />Community Development Director Frolik stated the setback is 40 feet in this neighborhood so <br />the side yard setback should be equal to the front yard setback. <br /> <br />Mr. Ronallo stated he wanted to angle it so it did not look detached and it would flow together. <br /> <br />Mayor Gamec asked if he could move the pool. <br /> <br />Mr. Ronallo stated he would like some space between the two garages and have a patio between <br />them with a fence. <br /> <br />Community Development Director Frolik stated the existing garage was 44 feet from the existing <br />property line and come July 11, the new garage could be 4 feet closer than the existing garage. <br /> <br />Councilmember Zimmerman stated that if the Planning and Zoning Commission could not find a <br />hardship, he could not either. <br /> <br />City Council/June 25, 2002 <br />Page 23 of 34 <br /> <br /> <br />
