City Attorney Goodrich noted that they were currently addressing the grant contract. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Hendriksen, to adopt Resolution <br />#02-08-183 allowing the City to enter into an agreement with the State of Minnesota for design, <br />construction, and operation of a NORTHSTAR COMMUTER COACH demonstration project <br />Park and Ride facility and pursuant to the amendment terms presented this evening together with <br />those additional terms discussed at this meeting, which would include that the City is not liable <br />to maintain a replacement park and ride, and in the event there is no longer a commuter coach the <br />City will not be under the obligation to provide and maintain the facility. <br /> <br />Further discussion: Councilmember Zimmerman stated that the motion does not state where the <br />facility shall be constructed. City Engineer Olson replied that the case does include a site plan of <br />the proposed location. City Attorney Goodrich noted that the agreement does refer to the site <br />plan (exhibit I). Councihnember Hendriksen recommended that the motion be contingent upon <br />the execution of the lease agreement. <br /> <br />Motion was amended to be contingent upon the execution of the lease agreement. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Hendriksen, and <br />Anderson. Voting No: Councilmember Zimmerman. <br /> <br />Case #5: Authorize Lease Agreement with Property Owner for Park and Ride Facility <br /> <br />City Administrator Norman stated that a previous case discussed a grant agreement with the State <br />of Minnesota and the City of Ramsey for the design plan, construction, and operation of a <br />NORTHSTAR COMMUTER COACH demonstration project Park and Ride facility. The City's <br />obligation is to provide the property for the Park and Ride facility. Staff is in the process of <br />completing negotiations with the property owners of BMA Associates for the property west of <br />Ramsey Boulevard and immediately north of the BSMA railroad tracks (map attached). The <br />City Attorney continues to negotiate the language of the lease agreement that was presented to <br />the City Council during the special meeting on August 5, 2002. (The draft of the lease <br />agreement is attached to the Council agenda.) <br /> <br />Councilmember Hendriksen stated that if they can't negotiate an agreement up front that the City <br />would not be responsible for the removal of the facility at the end of the lease then he did not <br />think they should enter into the lease agreement. His concern is that ifBMA's expectation is that <br />the City remove the facility and they are unwilling to sign it in any other way, then it is <br />unrealistic that in 10 years they will change their mind. <br /> <br />Jon Feges stated that he is representing the group that currently has a contract as Ramsey Town <br />Center LLC to purchase the property. He stated that there is a gross dollar amount for the grant <br />application, and of those funds there was money allocated for the acquisition of property.
