However, a substantial
portion of her back yard is encumbered by a drainage and utility easement. Ms. Nielsen has
submitted a request to vacate a portion of that easement. On August 19, the City Council
introduced the ordinance to vacate a portion of the drainage and utility easement on Lot 7, Block
8, as requested. However, the Council also requested additional information regarding the
backyard elevations on Lot 7 and elevations of adjacent easements that would be affected by the
vacation.

City Engineer Olson reviewed the elevations of the existing residents as well as low lying
residents to the north. Staff did feel that there was adequate protection for any instance of
overflow with the vacation of the drainage and utility easement as proposed.

Councilmember Zimmerman stated that there was a 20-foot easement and now if they have to
dig up the pipe they only have a five-foot easement.

City Engineer Olson explained that it is a shallow pipe and five feet would be adequate to access
the pipe if needed.

Councilmember Zimmerman replied that they would not be able to get an excavating machine on
the site with only a five-foot easement.

City Engineer Olson explained that the property is adjacent to park property, which would allow
the City to gain access to the area.

Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Ordinance
#02-29 to vacate a portion of the drainage and utility easement on Lot 7, Block 8, Amber Ridge.

A roll call vote was performed by the Recording Secretary:

Councilmember Kurak aye
Councilmember Zimmerman aye
Councihnember Anderson aye
Councilmember Hendriksen aye
Mayor Gamec aye

Motion carried.

City Council/September 11, 2002
