If they can come up with a resolution, then he will support <br />them and if they see someone damaging property then stop them. <br /> <br />Case #2: <br /> <br />Adopt Ordinance to Vacate a Portion of Drainage and Utility Easement in <br />Amber Ridge: Case of Carole Nielsen <br /> <br />Community iDevelopment Director Frolik stated that Carole Nielsen at 14950 Argon Street NW, <br />Ramsey, was proposing to construct a utility shed in her back yard. However, a substantial <br />portion of her back yard is encumbered by a drainage and utility easement. Ms. Nielsen has <br />submitted a request to vacate a portion of that easement. On August 19, the City Council <br />introduced the ordinance to vacate a portion of the drainage and utility easement on Lot 7, Block <br />8, as requested. However, the Council also requested additional information regarding the <br />backyard elevations on Lot 7 and elevations of adjacent easements that would be affected by the <br />vacation. <br /> <br />City Engineer Olson reviewed the elevations of the existing residents as well as low lying <br />residents to the north. Staff did feel that there was adequate protection for any instance of <br />overflow with the vacation of the drainage and utility easement as proposed. <br /> <br />Councilmember Zimmerman stated that there was a 20-foot easement and now if they have to <br />dig up the pipe they only have a five-foot easement. <br /> <br />City Engineer Olson explained that it is a shallow pipe and five feet would be adequate to access <br />the pipe if needed. <br /> <br />Councilmember Zimmerman replied that they would not be able to get an excavating machine on <br />the site with only a five-foot easement. <br /> <br />City Engineer Olson explained that the property is adjacent to park property, which would allow <br />the City to gain access to the area. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Ordinance <br />#02-29 to vacate a portion of the drainage and utility easement on Lot 7, Block 8, Amber Ridge. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Kurak aye <br />Councilmember Zimmerman aye <br />Councihnember Anderson aye <br />Councilmember Hendriksen aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />City Council/September 11, 2002 <br /> Page 14 of 31 <br /> <br /> <br />
