Councilmember Kurak inquired as to what they would be allowed to do by adopting the <br />proposed ordinance without a comprehensive plan change. <br /> <br />City Attorney Goodrich replied that the ordinance would enhance the Council's control. <br /> <br />Councilmember Kurak inquired if a developer comes forward and requests a comprehensive plan <br />amendment, do they test the ordinance once. <br /> <br />City Attorney Goodrich replied that typically a major developer would look at the City's <br />comprehensive plan and see what is permitted and then apply for that particular use. He did not <br />think that they would see a residential area changed to industrial or commercial. <br /> <br />Councilmember Kurak agreed, but felt that they would probably see a change to a higher <br />residential zoning. She stated that she did not see a developer going through the costs and then <br />pulling the plan at the end. She inquired if the City Attorney felt that the ordinance would be an <br />asset <br /> <br />City Attorney Goodrich replied yes. <br /> <br />Councihnember Hendriksen stated that a developer needed medium density to build Mallard <br />Ponds and what was built there seemed to satisfy the neighborhood, but the medium density <br />designation could have permitted the developer to construct two apartment buildings, which <br />would have included 75 units each. The Council probably would not have approved the plan <br />with the apartments, but the developer could have changed his mind after receiving the rezoning <br />and built the apartment units. <br /> <br />Principal Planner Trudgeon noted that Mallard Ponds was done as a planned unit development. <br /> <br />Councilmember Hendriksen stated that all of the property in Reilly Estates development had an <br />approved plat and at some point the developer stopped the development and changed the density <br />of the entire plat. <br /> <br />Councilrnember Zimmerman stated that he thinks the only thing the Met Council would be <br />concerned about is the use. <br /> <br />Councilmember Anderson stated that as long as the land use is the same the Met Council would <br />not be involved. <br /> <br />Councilmember Hendriksen stated that the concern he has is that the Council agrees to a land use <br />change and then the plan does not move forward, the City wants to revert it back to its pervious <br />use and the Met Council will not make the change. <br /> <br />Councilmember Kurak inquired as to what Councilmember Hendriksen would like to see done <br />and where he stands on the proposed ordinance. <br /> <br />City Council/September 24, 2002 <br /> Page 5 of 6 <br /> <br /> <br />
