removed as part of the development. The plat also contains Outlot A (approximately 0.7 acres)
which is located across Ramsey Boulevard from the main tract. The outlot is entirely wetland.
Wurm-Paumen Properties, LLC is proposing to extend 158th Lane NW into the parcel to provide
access to four of the lots. Due to the substantial amount of wetland on the property, Lot 1 will
require access fi'om Country Road 56. The property is also subject to the Ramsey Park and Trail
Plan and will be required to dedicate a 75-ft. trail corridor connecting Central Park and Elm Crest
Park. A revised preliminary plat was submitted that shows the trail con-idor. The exact area of the
trail will need to be verified before the Park Commission can draft a formal Park Dedication
recommendation. Staff recommended preliminary plat approval contingent on City Staff Review
Letter dated August 29, 2002, revised September 17, 2002.

Councilmember Kurak inquired if the DNR permits and the Lower Rum River permits had been
addressed.

Ross Abel, John Oliver & Associates, stated that he spoke with Tom Hovey from the DNR and
be informed them that if they limit the impact on the wetland to less than 400 square feet, a
permit will not be required by the DNR. They have submitted their application to the Lower
Rum River and it was his understanding that they moved to approve the permit at their last
meeting.

Principal City Engineer Olson replied that the Lower Rum River did approve the permit.

Councilmember Hendriksen stated that just off Ramsey Boulevard there is an area that is being
mowed that has not been mowed for years and inquired if that is the area being proposed for
development.

Mr. Abel replied that the developer has done some mowing on the property to accommodate
viewing by the Park Commission.

Councilmember Hendriksen inquired if they had done any wetland delineation of the property
because the property use to be a hay field many years ago and it was abandoned because the land
was too wet. He expressed concern with placing a home on property that has in the past had
continuous standing water.

Mr. Abel replied that they have delineated the wetlands. He explained that the lowest floor
elevation will be above the overflow point identified on Ramsey Boulevard.

Councilmember Hendriksen inquired if staff was sure that it was a buildable site.

Principal City Engineer Olson noted that the developer did adjust the lot to be three feet higher at
the request of the Lower Rum River. He stated that Ramsey Boulevard would have to flood
before the house would flood.

City Council/September 24, 2002
