ADDENDUM NO. 1 <br />IP 18-08 TROTT BROOK BOARDWALK <br />CITY OF RAMSEY <br />Page 3 of 5 <br />The Contractor will be responsible for initiating, maintaining and supervising all safety <br />precautions and programs in connection with the Work. The Contractor will take all <br />necessary precautions for the safety of, and will provide the necessary protection to <br />prevent damage, injury or loss to: All employees on the Work and other persons who <br />may be affected thereby; All the Work and all materials or equipment to be incorporated <br />therein, whether in storage on or off the Work site; and Other property at the Work site or <br />adjacent thereto, including trees, shrubs, lawns, walks, pavements, roadways, structures <br />and utilities not designated for removal, relocation or replacement in the course of <br />construction. <br />• Changes in the Work: Without invalidating the Agreement, the Owner may, at any time <br />or from time to time, order additions, deletions or revisions in the Work; these will be <br />authorized by Change Orders. Upon receipt of a Change Order, the Contractor will <br />proceed with the Work involved. All such Work shall be executed under the applicable <br />conditions of the Contract Documents. If any Change Order causes an increase or <br />decrease in the Contract Price or an extension or shortening of the Contract Time, an <br />equitable adjustment will be made as provided in the Contract Documents. <br />The Owner may authorize minor changes or alterations in the Work not involving extra <br />cost and not inconsistent with the overall intent of the Contract Documents. These may <br />be accomplished by a Field Order. <br />Additional Work performed by the Contractor without authorization of a Change Order <br />will not entitle him/her to an increase in the Contract Price or an extension of the Contract <br />Time, except in the case of an emergency as provided in elsewhere herein. <br />• Application for Partial Payment: Prior to the first Friday of the following month for <br />which payment is to be requested, the Contractor shall submit to the Owner a detailed <br />estimate of the amount earned for the Work for the previous month, and request payment. <br />As used in this section, the words "amount earned" means the value, on the date of the <br />estimate for partial payment, of the Work completed in accordance with the Contract <br />Documents. If the Contractor's estimate of amount earned conforms with the Owner's <br />evaluation, the amount due the Contractor will be made as a recommendation to City <br />Council for payment. After deducting the amount of all previous partial payments made <br />to the Contractor, the amount earned as of the end of the previous month will be made <br />payable to the Contractor after the fourth Tuesday of the following month. <br />The Contractor warrants and guarantees that title to all Work, materials and equipment <br />covered by an application for payment, will have passed to the Owner prior to the making <br />of the application for payment free and clear of all liens, claims, security interests and <br />encumbrances (elsewhere referred to as "liens"); and that no Work, materials or <br />
