Or upon recording: <br /> <br />Lot 1, Block 1, Sunwood Estates, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.05 of the Ramsey City Code on March 7, 2002, and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br /> <br />That the Subject Property is zoned R-3 Urban Residential and the Applicant has made proper <br />application to the City to develop the Subject Property with multiple family rental housing <br />consisting of 30 townhome units and 2 detached single family homes. <br /> <br />3. That Section 9.20.14 of the City Code requires a total lot area of 201,600 square feet for the <br /> Applicant's proposal for 30 townhome units and two single family homes. <br /> <br />That the Applicant has properly applied to replat the Subject Property as Sunwood Estates <br />and the plat consists of Lot 1, which is located east of Sunwood Drive and will contain the <br />housing units; the remainder of the property is situated on the west side of Sunwood Drive <br />N.W. and will be platted as Outlot A, most of which is wetlands. <br /> <br />5. That the total area of Lot 1 is 182,952 square feet, which is an 18,648 square feet deficit from <br /> the required 201,600 square feet for the number and types of units proposed. <br /> <br />That in the year 2000, the Subject Property was severed by the City Public Improvement <br />Project to extend Sunwood Drive from C.S.A.H. #5 to T.H. #47; and as a result, one (1) to <br />two (2) acres of developable land was utilized for wetland mitigation purposes and separated <br />from the bulk of the developable land that is now proposed to be platted and developed with <br />the housing units. <br /> <br />That if during the public improvement project to extend Sunwood Drive, the one (1) to two <br />(2) acres on the west side of Sunwood Drive had remained contiguous with the developable <br />land on the east side of Sunwood Drive, the Applicant's subdivision proposal for the size of <br />Lot 1 would exceed the minimum requirement of 201,600 square feet by at least 24,912 <br />square feet. <br /> <br />That the Applicant has stated that alignment of Sunwood Drive adversely impacted the <br />amount of contiguous, developable land on the Subject Property and has caused an undue <br />hardship. <br /> <br /> Resolution #02-03-072 <br /> Page 2 of 4 <br /> <br /> <br />
