mo <br /> <br />do <br /> <br />The City agrees to contribute a not to exceed amount of $150,000.00 to the cost of <br />constructing a 30" trunk sanitary sewer line from its existing location to the north <br />right-of-way of Alpine Dr. NW. <br />The City agrees to .allow the Developer to utilize all of the trunk fee money <br />generated from this first phase of 44 lots as well as an additional 156 lots that will <br />be platted in the future on land under the .Developer's control within the "triangle" <br />during a five.year period following the date of final approval of Villas of Meadow <br />Point. The "triangle" is defined by the right-of-ways of Alpine Drive NW, <br />County Road 5 (Nowthen Boulevard.), and County Road 57 (Sunfish Lake <br />Boulevard.). <br />The trunk fee money that the City is allowing the Developer to utilize is to be <br />used to construct the 30" trunk sanitary sewer line through the site and across <br />County Road 5 at a depth and alignment as approved by the City Engineer. <br />If the cost to construct the above mentioned 30" trunk sanitary sewer line through <br />the site plus a 25% increase for design, contract administration, legal, and <br />contingency 'is below that which will be generated from trunk fees, then the <br />difference will be due to the City from the Developer upon final platting ora <br />subsequent phase. <br /> <br />On October 11, 2002, the City of Ramsey received notification from the Minnesota <br />Environmental Quality Board that a valid citizen petition requesting that the City require an <br />Environmental Assessment Worksheet (EAW) be completed for Villas of Meadow Point. The <br />petition raises three potential environmental effects that could occur with the Villas of Meadow <br />Point development; 1) Harm to the natural habitat of the Blanding's Turtles, 2) Reduction of the <br />habitat for other wildlife, 3) Decline of water quality and supply. Under State law, the City <br />Council cannot make any final government approvals of a project until the need for an EAW has <br />been determined. State Statutes allow for the City Council to take up to 30 working days to <br />make a decision. The developer, in response to the petition, has indicated that they will be <br />bringing forward information addressing the citizen petition's concerns at the October 22, 2002 <br />City Council meeting. Under State law, the City has 30 working days to make a determination on <br />whether an EAW shall be conducted. The first item that the City Council must consider is to <br />make a decision on the citizen petition. The City Council will need to make a decision on <br />whether an EAW is needed by November 22, 2002. If the issues raised by the citizen petition are <br />resolved and the City Council wants to consider approving the preliminary plat, staff would <br />recommend that approval be contingent on the following items: <br /> <br />a. Compliance with City Staff Review Letter dated August 20, 2002, Revised September 20, <br /> 2002, Revised October 4, 2002, Revised October 18, 2002. <br />b. The applicant receiving site plan approval of the two-unit townhomes. <br />c. Language being inserted into the Development Agreement that define the financial <br /> responsibilities between the City and the Developer regarding extension of sanitary sewer <br /> trunk lines. <br />d. The City Council finding that an EAW is not necessary or warranted for the Villas of <br /> Meadow Point subdivision. <br /> <br />City Council/October 22, 2002 <br /> Page 28 of 37 <br /> <br /> <br />
