Mayor Gamec inquired as to what the late fee would be and inquired if the County charged a late <br />fee. <br /> <br />Director of Public Works/Fire Chief Kapler replied that the County did not mention anything <br />about a late fee. <br /> <br />Mayor Gamec recommended that staff add information regarding a late fee when the issue is <br />placed before the Council. <br /> <br />Councilmember Hendriksen inquired as to why they would be differentiating between boring and <br />trenching because they do a similar amount of damage. He did not think that the City should be <br />planning on fixing the area unless in the few instances that it gets left. He also did not feel that <br />the fees should be used to correct what the developer does because it might encourage the <br />developer to do a cheap job to get the job done quickly. <br /> <br />Director of Public Works/Fire Chief Kapler stated that the fees would be used in the exception of <br />when a developer leaves the work unfinished. When they discussed the issue of boring versus an <br />open trench the thinking was more of crossing the driveway or crossing the street. <br /> <br />Councilmember Hendriksen stated that he thought the City should take a bond for both boring <br />and open trench and collect a higher fee. He inquired as to when the bond would be released so <br />that if the damage is not detected until the following spring because the boring was done in <br />December would the City still be covered by the bond. <br /> <br />Director of Public Works/Fire Chief Kapler suggested combining boring and open trench into <br />one category. In regards to the bond as to when it is released he stated that he would like to <br />consult with the City Attorney regarding that issue. <br /> <br />Councilmember Hendriksen stated that there should be something written in the policy that if a <br />contractor starts work without the appropriate permits there will be a penalty. <br /> <br />Councilmember Anderson stated that if a driveway and it is trenched, no matter how it is fixed it <br />always looks patched. She inquired if there was way to require that boring be done under <br />driveways rather than trenching. <br /> <br />Director of Public Works/Fire Chief Kapler stated that there is language in the policy that states <br />that if at all possible they must bore. He requested permission from the Committee to consult <br />with the City Attorney if the City were to charge a late fee would the City be incurring any <br />liability. <br /> <br />Councilmember Anderson stated that with having to walk to school there would be additional <br />safety concerns with having open trenches. <br /> <br />Councilmember Zimmerman inquired if a $2,000 bond was adequate. <br /> <br />Public Works Committee/March 19, 2002 <br /> Page 6 of 18 <br /> <br /> <br />
