construct a storm sewer overflow from the pond on the south side of Ute Street. This action was <br />ratified by the City Council, but Staff was directed to bring the results of the negotiations back to <br />the Public Works before final action. City Principal City Engineer Olson explained Bill's <br />Superette has been willing to sign an easement to allow a trail, he only wants the restoration to be <br />complete and the sprinkler moved. The clinic has the same requests. They are estimating about <br />$500 for the restoration on the clinic property and about $200 on Bill's Superette's property. <br />They are asking for a permanent easement of 15 feet and a temporary easement of 10 feet. <br /> <br />Chairperson Zimmerman inquired about Parcel 3. <br /> <br />Principal City Engineer Olson explained they have initiated discussions with that individual. He <br />first asked for a wood paneled fence and they agreed, it sounds reasonable to shield the sidewalk <br />from his residents. They contacted him regarding the retaining wall that is necessary to put the <br />fence in. They asked him two questions. First was whether the retaining wall should be put on <br />the street side or whether it should be on the house side of the sidewalk. They felt the house side <br />would provide him an eight-foot barrier instead of a six-foot barrier. The second reason was <br />there was discussion staff wise that a modular retaining wall be used. They felt it would be much <br />easier to maintain and cheaper in construction standards. He said he would not accept a Menard's <br />wooden fence, he wanted a sound wall similar to the one on Highway 47. When they compared <br />the cost they arewell over $20,000 for a 15 foot permanent easement that would extend the <br />length of his property. They felt this was an exorbitant cost, and he did not want to negotiate any <br />more. <br /> <br />Councilmember Hendriksen asked if staff feels any further discussion would be productive with <br />Parcel #3. He asked who is conducting the discussions. <br /> <br />Principal City Engineer Olson responded Mike McDowell has contacted him a number of times <br />and he has not been receptive. About a year ago a letter was written by this individual requesting <br />a sound wall for the whole length of Alpine Drive, the letter did not receive attention. <br /> <br />Councilmember Hendriksen asked if the rest of the parcels have come to an amicable conclusion. <br /> <br />Principal City Engineer Olson responded in the affirmative. <br /> <br />Councilmember Hendriksen asked when they would need to begin proceedings if they need to do <br />something other than talk with Parcel #3. <br /> <br />Principal City Engineer Olson responded condemnation requires 90 days. <br /> <br />Councilmember Anderson asked if this is part of the school walkway on Alpine Drive. <br /> <br />Principal City Engineer Olson responded in the affirmative. <br /> <br />Mayor Gamec suggested this be forwarded to the Council for consideration and to possibly <br />proceed with condemnation. <br /> <br />Public Works Committee/July 16, 2002 <br /> Page 25 of 28 <br /> <br /> <br />
