Principal City Engineer Olson responded he would much rather negotiate, he does not think it
would work to tell him they will condemn his property if he is not willing to negotiate. He has
been pretty abrasive and does not want the sidewalk.

Mayor Gamec stated if this is left for another two or three months it Will not get done and will be
a problem with the school kids.

Motion by Councilmember Anderson, seconded by Mayor Gamec, to move this to Council with
the recommendation they negotiate if possible, but authorize the condemnation procedure. -

Further discussion: Chairperson Zimmerman commented they could end up with the same costs
resulting from o ne o f t he parcels t hey d id o n Highway 4 7 plus $ 4,000 for attorney fees. He
suggested they work with this gentleman. Mayor Garnet stated they oould not waste the time, if
they left it and had to put in a 100-foot section next year they would pay double. Councilmember
Hendriksen said he agrees with everything that has been said. One alternative would be to
suggest that Director of Public Works Kapler talk to the gentleman. He noted this is 200 feet in
the middle of a long sidewalk that has to be there for the kids. If it is necessary they would have
to proceed with condemnation. Principal City Engineer Olson explained they discussed moving
it a little farther away so it is not near his property, but that would be where it crosses over and
would be dangerous. Councilmember Hendriksen requested this be on the agenda at the next
Council meeting.

Motion carried. Voting yes: Mayor Gamec, Councilmembers Anderson, Hendriksen, and
Zimmerman. Voting no: None. Absent: CouncilmemberKurak.

COMMITTEE INPUT

1) August Public Works Committee Meeting Rescheduled

Principal City Engineer Olson reported the August Public Works meeting has been changed to
August 19th'

2) Inventory of Street Lights

Public Works Supervisor Riemer reported he has been through about half the system of
streetlights.
