• <br />4. That Section 9.20.11 of the City Code establishes a 10 -acre minimum lot size and four (4) <br />units in 40 acres density restriction in the Rural Service Area. <br />5. That Section 9.11.01 of the Ramsey City Code states that no lot shall contain any building <br />used as a dwelling unless it has the minimum lot width; Section 9.02 states that the lot width <br />is measured at the building setback line on cul -de -sacs; Section 9.20.11 states that the <br />minimum lot width in the Rural Residential District is 200 feet and is measured at the <br />building setback line. <br />6. That the Applicants are proposing to plat the Subject Property into four (4) single - family <br />residential lots. <br />7. That the proposed plat complies with the 4 units in 40 -acre density restriction. <br />8. That Lots 1, 2 and 3 of the proposed plat are deficient of the lot size requirement by .11 <br />acres, .4 acres, and .21 acres, respectively. Lot 4, the remnant parcel is acceptable at 9.1 <br />acres because the minimum lot size for remnants is 7.5 acres. <br />9. That Lots 1 and 2 are deficient of the 200 foot lot width requirement at the 40 foot building <br />setback line by 81.75 feet and 150 feet, respectively. <br />10. That there are unique circumstances applying to the Subject Property that do not generally <br />apply to other properties in the District; namely the long, narrow configuration of the <br />Subject Property and the existence of a County ditch. <br />11. That the unique circumstances do not result from the actions of the Applicant. <br />12. That the variance requested is the minimum which would alleviate the hardship. <br />13. That if granted, the variance will not unreasonably diminish established property values <br />within the neighborhood. <br />14. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br />property. <br />15. That if granted, the variance will not violate the intent and purposes of the Comprehensive <br />Plan. <br />16. That if granted, the variance will not give the Applicant any special privilege that is denied <br />to other lands in the same district. <br />17. That such variance is necessary for the preservation of a substantial property right similar to <br />that possessed by other properties in the R -1 Rural Residential District, namely the ability to <br />plat property according to the 4 in 40 density restrictions. <br />18. That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of lands, structures or buildings in the same district. <br />Resolution #00 -04 -081 <br />Page 2 of 3 <br />
