Chairperson closed the regular portion of the Planning Commission meeting at 7:4I] p.m. in order
to conduct the following public hearing.

Public Hearing

Chairperson Nixt called the public hearing to order at 7:48 p.m.

Presentation

Mr. Jankowski presented North Fork's request for a grading permit to export approximately
300,000 yards of soils from the proposed St. Andrews plat. Mr. Peck described the several
options for destinations for the material in the previous case and haul routes.

Citizen Input

Larry Koshak - 15700 St. Andrews Lane N.W. - Stated the project is an extremely large one and
he doesn't believe that there is much ground that won't be uncovered at any given time. This is a
residential area and without proper erosion and sedimentation control, this project is not
acceptable. There will be a lot of dust associated with this project. The developer does not have
a good record as far as erosion control; these issues have been raised on past projects and nothing
has been done. It seems that there is no communication or control between North Fork and their
contractor, Rehbein. The work he has most disagreement with in the past occurred on weekends
and there is no one at City Hall to address the issues. In this project, hours of operation should
be limited to the regular work week and exclude weekends.

Upon inquiry from Commissioner Reeve, Mr. Jankowski stated that the permit requires a
financial surety that the applicant places with the City for these types of conditional use permits
and the standard amount is $5,000, which would not be sufficient for a project this size.

Mr. Dennis Peck, Director of Development for Northfork - Asked the Commission to keep Mr.
Koshak's comments in perspective as he is the only resident that attended the public hearing to
complain about proposed project. Mr. Peck stated that he is willing to provide a larger financial
surety, he did not know the contractor worked on weekends, and Rehbein will not be the
contractor on this project. With regard to timing, Mr. Peck stated that they would like to move as
much of the material as possible before the golf course opens up for business in the Spring, but
they will only move it as they market it and they want the full 3 year term on the permit, as stated
in City Code.

Adjournment

Motion by Commissioner Kociscak and seconded by Commissioner Wivoda to adjourn the
public hearing.

Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Kociscak, Reeve, Watson, and
and Wivoda. Voting No: None. Absent: Commissioners Johnson and Griffiths.
Planning Commission/January 2, 2001
