is being relocated by the City further west to an area proposed to be platted as Gateway North <br />Industrial Park No. 5. All 4 lots in the proposed plat exceed the 1 acre minimum lot size and 200 <br />foot lot width requirements. The plat will receive public access from 141st Avenue and Ebony <br />Street. The plat will be serviced with municipal services. <br /> <br />Citizen Input <br /> <br />Jeff Schatt- St. Paul Terminals dPo/a Danny's Tranny's - 14050 Basalt Street N.W. - Stated that <br />for the past 2 years, St. Paul Terminals has been in the process of bringing the scrap yard into <br />compliance with the conditional use permit. They are trying to run an efficient, clean operation. <br />Their operation is on Lots 1, 2, 3 and 4, Block 4, Gateway North Industrial Park 2 and they were <br />approached several months ago by the City's appraisor regarding extending 14Pt Avenue as a <br />public street and City services between their lots 1 and 2 and until now, they have heard nothing <br />more. They are concerned that the noise and visual aspects of the scrap yard will become an <br />issue for businesses developing west of their site in the new industrial park. It appears that the <br />City is approving a plat with no access because what is supposed to be 141st Avenue is private <br />property that has not been acquired. In addition, if 141st were extended as public street to the east <br />to intersect with Basalt, a very expensive scale and building access at Danny's Tranny's would <br />have to be moved as the easement rights are within 6 inches of their building. Stated a desire to <br />know what the City's plans are because it impacts their business plan. Mr. Schaat also noted that <br />he would not have known about this meeting if Mr. Karst hadn't told him. Mr. Schaat stated that <br />he doubts the City knows how much has taken place on the site since they purchased it from <br />Karst. They have been working quite closely with Anoka County to bring the operation into <br />compliance and that has been quite costly. <br /> <br />Chairperson Nixt stated that Danny's Tranny's is under a conditional use permit which runs with <br />the land and the City cannot revoke the permit unless the Permittees are not in compliance with <br />the terms of the permit. <br /> <br />It was noted that the City does have control over a portion of property that is proposed to plat <br />141~t Avenue to the west and it is from this section of 141st that the plat will have public access. <br /> <br />Mr. Schatt stated that another critical issue is that their scrap yard is supposed to be operating on <br />only Lot 1, but has expanded to Lots 2, 3 and 4. After they complete their site clean up, they <br />were planning to approach the City within a year for a conditional use permit amendment to <br />legalize the use of Lots 2, 3 and 4. This problem was inherited with the purchase of the property <br />from Dan Karst. St. Paul Terminals wants to operate the right way and are concerned that the <br />process to legalize the use of Lots 2, 3 and 4 may be an issue next year with'their new neighbors. <br /> <br />Chairperson Nixt replied that if St. Paul Terminals is engaging in a use that requires a conditional <br />use permit, he would encourage them to continue to work with the City. The City is not out to <br />put people out of business, but we do want to protect our interests. <br /> <br />Ms. Frolik noted that because St. Paul Terminals is purchasing the property on a contract for <br />deed, Mr. Karst is still listed as the fee title owner and that is why the hearing notice was sent to <br />Planning Commission/January 2, 2001 <br /> Page 8 of 15 <br /> <br /> <br />
