Community Development Director Frolik stated the City Council is not interested in causing a <br />delay for Verizon's request. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Kociscak, to recommend that the City <br />Council adopt Findings of Fact relating to a request from Verizon Wireless for a conditional use <br />permit to install a cellular antenna system on the City water tower and construct a 12 foot by 30 <br />foot equipment building on City owned property, subject to requiting reasonable versus 100% <br />screening, requiring the applicant to relocate equipment to a City structure if necessary, adding <br />Findings of Fact in the Resolution relating to City Code Section 9.15.04c. 1, a, b, c and d. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Kociscak, and Wivoda. Voting <br />No: None. Abstain: Commissioner Reeve. Absent: Commissioner Johnson. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Kociscak, to recommend that the City <br />Council approve the request for a conditional use permit and adopt a resolution declaring terms <br />of same with the lease containing acceptable provisions to the City regarding the applicant's <br />willingness to relocate to a City owned structure if the City Council decides that is the direction <br />they want to go on this site. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Kociscak, Watson and Wivoda. <br />Voting No: None. Abstain: Commissioner Reeve. Absent: Commissioner Johnson. <br /> <br />Commissioner Reeve returned to his position on the Planning Commission. <br /> <br />Case #2: <br /> <br />Request for a Conditional Use Permit to Exceed Accessory Building Height <br />Restrictions; Case of Jeff Hansen <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 7:45 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing back to order at 7:45 p.m. <br /> <br />Presentation <br /> <br />Community Development Assistant Wald explained that the City has received an application <br />from Jeff Hansen for a conditional use permit to exceed the detached accessory building height <br />restrictions established in City Code on the property located at 6250 152nd Avenue NW. She <br />stated the subject property is approximately 1.3 acres in size and is located within the <br />Metropolitan Urban Service Area (MUSA). City Code restricts detached accessory buildings to <br />sixteen feet in height if the property is located within the MUSA area. The applicant is <br />requesting to construct a detached accessory building that would be 18 feet 2 inches in height, <br />which results in a two foot two inch deviation from City Code. The applicant would like to <br />exceed the 16-foot height restriction in order to construct a detached accessory building that <br />closely matches the height and width of the existing attached garage.
