(MUSA). City Code restricts detached accessory buildings to sixteen (16) feet in height if the <br />property is located within the MUSA area. The applicant is requesting to construct a detached <br />accessory building that would be 27 feet in height, which results in an 11-foot deviation from <br />City Code. The applicant would like to exceed the 16-foot height restriction in order to construct <br />a detached accessory building that closely matches the height of the existing residence. The <br />applicant will not exceed the maximum allowable square footage for accessory buildings. The <br />accessory building will closely match the height of the existing attached garage. The Applicant <br />has stated that the detached accessory building will be utilized for personal storage. He pointed <br />out that the plans call for a window near the top and assured the applicant that that area cannot be <br />used for a residence nor business. The proposed detached accessory building will be located in <br />the rear yard approximately 60' north of the principal dwelling. The proposed accessory <br />building location exceeds the six (6) foot side yard and five (5) foot rear yard setbacks <br />established in the residential urban area. The Applicant is proposing to install a driveway to the <br />detached building. Staff is recommending approval of Jeff Welle's request for a conditional use <br />permit to exceed the accessory building height restriction established in City Code. <br /> <br />Citizen Input <br /> <br />None. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Sweet, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, SWeet, Kociscak, <br />Reeve, and Watson. Voting No: None. <br /> <br />The public hearing closed at 8:12 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 8:12 <br />p.m. <br /> <br />Motion by Commissioner Johnson, seconded by Chairperson Nixt, to recommend that City <br />Council adopt findings of fact favorable to applicant relating to Jeff Welle's request for a <br />conditional use permit to exceed the accessory building height restriction. <br /> <br />Further discussion: Commissioner Sweet stated she was opposed. She explained that she felt if <br />rules were in place, they should be followed. Principal Planner Trudgeon noted this property is <br />within the MUSA, so the height restriction is 16 feet. If this was outside the MUSA, the height <br />restriction would be 27 feet and this is 25 feet. Chairperson Nixt stated he would approve this <br />request since the property already has height in the house.
