Community Development Director Frolik stated that on December 12, 2000, the City Council <br />introduced an ordinance to rezone the northerly portion of Outlot C, River's Bend 3rd Addition <br />front B-1 to B-2 Business to facilitate development of the property with a Holiday store that <br />includes gasoline sales. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to adopt Ordinance #01-01 to <br />rezone a portion of property in River's Bend 3rd Addition from B-1 to B~2 Business. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Zimmerman aye <br />Councilmember Kurak aye <br />Councilmember Anderson no <br />Councilmember Hendriksen aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Councihnember Hendriksen stated that, due to the location of the gas station, he does not feel <br />they should be allowed to be open 24 hours, but he was unsure as to how they should address <br />that issue. <br /> <br />Mayor Gamec inquired as to how the City can tell one business that they can be open 24 hour, <br />but another cannot. <br /> <br />City Attorney Goodrich replied that the Council could state that, due to the close proximity of <br />residential locations to the gas station, they feel that hours should be limited. <br /> <br />Consensus was to add #16 to the conditions of the approval to read: "That because of the <br />proximate location of residential properties, the hours of operation should be limited to either <br />5:00 a.m. to 11:00 p.m. or 6:00 a.m. to 12:00 a.m. at the permit holder's option. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Hendriksen, to grant site <br />plan approval of the proposed site plan for a Holiday Gas Station contingent upon compliance <br />with City staff review letter dated December 1, 2000, and the addition of condition #16 <br />pertaining to hours of operation. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Hendriksen, and <br />Kurak. Voting No: Councilmember Anderson. <br /> <br />City Council/January 9, 2001 <br /> Page 29 of 35 <br /> <br /> <br />
