Motion by Mayor Gamec, seconded by Councilmember Zimmerman, to adopt Ordinance #01-04 <br />to create the Tower Overlay District. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Hendriksen aye <br />Councihnember Anderson aye <br />Councilmember Kurak aye <br />Councilmember Zimmerman aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #7: Proposed Amendment to Tower Ordinance <br /> <br />Principal Planner Trudgeon stated that during the discussion regarding the Tower Overlay <br />District, the City Council instructed staff to draft an additional amendment to the newly adopted <br />tower ordinance. Specifically, the Council asked that the setback from lot lines for towers be <br />changed to 1 I/2 times the height of the actual tower. The City recently made significant changes <br />to ordinances governing the placement of towers in residential districts. One of the adopted <br />changes required that all towers be set back at least 1-½ times the height of the tower for any <br />residential structure. The City Council has asked that this language be changed to require that <br />the 1-½ times setback be measured from the lot lines and not from any residential structure. Due <br />to the proposed ordinance amendment, staff found that language regarding setbacks for towers <br />located in business and industrial districts needed to be clarified. The Planning Commission held <br />a public hearing for the proposed ordinance at its February 6, 2001 meeting. One person testified <br />in support of the proposed ordinance. The Planning Commission recommended that the <br />proposed ordinance be adopted. <br /> <br />Councihnember Anderson stated that the second "d" under section 9.15.08 seemed to eliminate <br />any additional setback from a lot line. <br /> <br />Principal Planner Trudgeon replied that if a qualified engineer could prove that a tower would <br />not be harmfitl then it could be a loop hole for a company to place an antenna on the lot line. <br /> <br />Community Development Director Frolik replied that if the Council would prefer that section be <br />removed from the ordinance, that could be done prior to final adoption. <br /> <br />Consensus of the Council was to remove the second "d" from section 9.15.08. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Kurak, to introduce an <br />ordinance regarding setbacks for commercial towers located in residential districts as amended. <br /> <br />City Council/February 13, 2001 <br /> Page 12 of 28 <br /> <br /> <br />
