Voting No: None. <br /> <br />Case #8: <br /> <br />Request for a Conditional Use Permit to Construct a Monopole <br />Telecommunication Tower; Case of American Tower Corporation <br /> <br />Principal Planner Trudgeon stated that the City received an application from American Tower <br />Corporation to construct and operate a 175-foot monopole telecommunication tower for Verizon <br />Wireless on the property located at 14165 Ramsey Boulevard, which is owned by Bruce Volk. <br />At the January 23''d City Council meeting, the Council tabled a decision on the matter until <br />American Tower Corporation provided more information on why the proposed antenna could not <br />go on the new water tower being constructed on Sunwood Drive. The applicant has waived the <br />60-day rule in order to explore options for the location of its tower. 'They are investigating the <br />new water tower site as a possibility for the location of the Verizon antenna. At this time, the <br />applicant would like to keep the original application open until it can be determined that the <br />water tower location can serve Verizon's needs. <br /> <br />Case #9: <br /> <br />Direct City Attorney to Review January 23, 2001 Proposed Charter <br />Amendment Petition and Report on Sufficiency <br /> <br />City Administrator Norman stated that the City Council received a proposed Charter Amendment <br />petition during the regular City Council meeting of January 23, 2001. According to State <br />Statute, the City Council is obligated to schedule a special election if the petition meets all the <br />requirements. The special election must be held within a 90-day period. The City Clerk has <br />reviewed the petition signatures and determined that the required amount of signatures are <br />registered voters and it is in order to file for a special election. The next stop in the process is to <br />have the City Attorney review the proposed amendments to Chapter 5 of the City Charter to <br />determine if it is in compliance with the State Statutes and the State Constitution. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Kurak, to direct the City <br />Attorney to review the proposed Charter Amendment petition to determine if it is in compliance <br />with State Statutes and State Constitution. <br /> <br />Motion carried.
