Mayor Gamec stated a lot of times comments are made during the public hearing about standing <br />water or "birdbath" areas which can be corrected during such a project. <br /> <br />City Engineer Olson stated it is only with a project of this magnitude that a correction like that <br />can successfully be made. <br /> <br />Loretta Olson stated there are some cracks in High Point but they want the potholes fixed. <br /> <br />Mayor Gamec stated with the petition that was submitted, the project will not proceed so only <br />normal repair will be conducted. He suggested that the City Engineer meet with residents of this <br />project to address their concerns and, perhaps, hold another hearing. <br /> <br />City Attorney Goodrich read the Section 4.50.01 Streets, Subdivision 3, Seal Coating, paragraph <br />e., which indicated: "In the event the benefited property owners petition to defeat a sealcoating <br />project, the benefited property owners will be assessed 100% of the cost when the sealcoating <br />improvement is finally completed. The reason for this 100% assessment is that the cost of <br />sealcoating is substantially increased when a street has missed its normally scheduled sealcoating <br />maintenance, which sealcoating generally is on an every six-year schedule." <br /> <br />Director of Public Works Kapler stated staff would schedule a neighborhood meeting to receive <br />their comments. <br /> <br />Loretta Olson stated she is willing to pay for the project if it is done correctly. <br /> <br />Councilmember Hendriksen noted this is not the typical time a petition is submitted but if it is <br />officially received, it has an impact on how much the residents and City will pay. He asked if the <br />residents should hold the petition until the appropriate time and after learning of the implications <br />of the petition. <br /> <br />City Attorney Goodrich stated the residents could hold the petition for 60 days until the <br />neighborhood meeting is held and issues resolved. <br /> <br />Councilmember Hendriksen explained that receiving the petition tonight will "tie the hands" of <br />the City Council in what they can do. <br /> <br />Mr. Wrobel stated he will withdraw the petition on the condition that a meeting is held and they <br />can discuss the problems. <br /> <br />Director of Public Works Kapler committed to holding the meeting within 30 days. <br /> <br />Mr. Wrobel stated if their concerns are not resolved, he will be right back to resubmit the <br />petition. <br /> <br />City Council/March 13, 2001 <br /> Page 16 of 31 <br /> <br /> <br />
