Mayor Gamec replied that the Density Transition issue would have to be discussed at a work <br />session. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman to add Case <br />5a: Density Transition Ordinance, to the agenda. <br /> <br />Further discussion: Councilmember Kurak stated that none of the other Councilmembers are <br />prepared to discuss the issue at length during this meeting. Councilmember Hendriksen replied <br />that it has been the policy of the City that a Councilmember can request that a case is added to <br />the agenda, but in this case, the City Administrator chose not to add it. City Administrator <br />Norman stated that the Council does have the right to place the issue as a case on the agenda. He <br />did not block the issue from being placed on the agenda. Councilmember Hendriksen replied <br />that he did not think that they needed three votes of the Council to place an item on the agenda. <br />In the past any Councilmember has had the right to place an item on the agenda and he contacted <br />City Hall well in advance to the agenda deadline. <br /> <br />Motion carried. Voting Yes: Councilmembers Hendriksen, Anderson, and Zimmerman. Voting <br />No: Mayor Gamec, and Councilmember Kurak. <br /> <br />Councilmember Zimmerman inquired if the Planning Commission or City Council will hold the <br />Comprehensive Plan public hearing. <br /> <br />City Attorney Goodrich replied that the Planning Commission is required to hold the public <br />hearing. He explained that after the public hearing is held it will come back to the Council for <br />approval and then the rezoning of the property would be a separate procedure that would also <br />require public hearings. Any rezoning that takes place on less than five acres in size State law <br />does not require individual notice, but a general notice in the City's legal paper. <br /> <br />Councilmember Zimmerman inquired if there would be any public hearings at the City Council <br />level following the Planning Commission public hearing. <br /> <br />City Attorney Goodrich replied that the City Council could choose to hold an additional public <br />hearing. <br /> <br />Councilmember Anderson stated that public hearings were held during the writing of the <br />Comprehensive Plan process and the law requires that the City bring the zoning into compliance <br />with Comprehensive Plan so if any changes were made to land use would the City need to make <br />minor amendments to the Comprehensive Plan. <br /> <br />City Attorney Goodrich replied that the comprehensive zoning has to be in compliance with the <br />Comprehensive Plan and if the City varies from that zoning then the City would have to make a <br />minor amendment to the Comprehensive Plan. <br /> <br />City Council/April 10, 2001 <br /> Page 3 of 18 <br /> <br /> <br />
