(b) Suppotxive posts shall, be placed no more than eigN (8) feet <br /> apart. <br /> <br />2. Permanent Fencing. <br /> <br />(a) <br /> <br />All in-ground swimming pools and above-ground swimming <br />pools with a sidewall height less than fbur (4) feet must be <br />completely enclosed by a permanent fence or wall of a non- <br />climbing type, which bas no external handholds or fbothotds, <br />so as to be impenetrable by small children. Chain li~ fence <br /> <br />may be used. The entke enclosure must be at least four ('4) feet <br /> <br />in height. The opening between the bottom of the :fence and <br />the ground or other surface shall not be more than tl2ee (3) <br /> <br />inches. All outdoor fence or wall openings or outdoor points of <br />entry into the pool area shall be equipped with self-closing, <br />self-latching devices that are lockable. <br /> <br />All above-ground swimmin~ pools that have a minimum side- <br />wall height of tour (14) feet need not be fenced, but shall have <br />removable steps, which steps shall be removed when the <br />swimmin_o pool is unattended. In the event that an accessory <br /> <br />deck to the swimming pool is constructed, which is adiacent to <br />any part of the swimmin~ pool, said deck shall include, on its <br />entire outside perimeter, a 36-inch high guard rail. The guard <br />rail shall be constructed so that no open space within it is wider <br />than six (6') inches. <br /> <br />(c) All outdoor spas shall have either a fence as described in <br /> paragraph (a) above, or a secured cover. <br /> <br />c. Noise. <br /> <br />The swimming pool or spa shall be designed, constructed and sited <br />in such a wa,/ as to limit noise generated by its mechanical <br />equipment, so as not to create a nuisance and/or affect the <br />reasonable use and enjo,/ment of adiacent property owners. <br /> <br />'{'he swimming pool and/or spa shall be sited on the parcel so that <br />its mechanical equipment, including heating and filtering <br />equipment, is located at least thirty (30) fbet fi'om the inhabited <br />portion of neighboring residential structures. <br /> <br />d. Pool Walkway Deck and Deck Drains. Unobstructed deck areas not <br /> <br />less than fortv-ei~ht (48) inches wide shall be provided.to extend <br />entirely around each in-~round swimming pool. Swimmh~g pool <br />decks shall bc constructed' abox~e, but not more than nine (9) inches <br /> <br /> <br />
