Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Levine, Brauer, and
Shepherd. Voting No: Commissioner Van Scoy. Absent: Commissioner Watson.

Case #6: Wetland Buffer Ordinance

Prcsentation

lJorcn (k>rdon, consultant for the City, stated that at the last meeting the Planning Commission
reviewed thc proposed wetland buffer ordinance and he has incorporated those comments, along
with comments fi'om LRRWMO and the Environmental Policy Task Force. He stated that the
ordinance is based on the function and value approach, looking at establishing buffers based on
triggers of development. He stated the widths of the buffers vary based on the function of the
wetlands, and there would be alternative measures where buffers need to be wider or cannot be
inet because of topography, providing a number of ways to get protection around wetlands.

Mi-. Gordon talked about the monumentation process and how that would happen as a way to
denote where the wetlands are established.

Zoning and Recycling Coordinator Anderson indicated that what was handed out tonight is an
updated version of the ordinance from the one in the packet. He stated there is a two-page text
that reviews what revisions were made since the last meeting.

Commissioner Johnson noted Staff did a good job taking the comments from the Planning
Commission and incorporating them into the draft.

Commissioner Van Scoy asked who is responsible for determining what each wetland is and
what classification it should be given.

Mr. Gordon indicated there is an evaluation of the community underway, but it also happens by
having thc developer have a wetland scientist come in and do an evaluation. He stated it would
bc best to have one person that the City uses for this to provide a consistent approach.

Colnmissioner Van Scoy verified the responsibility is on the developer.

Mt'. Gordon stated it is, and if the developer does not have someone qualified or familiar with the
process thc City would take over the responsibility using escrowed funds from the developer.

Citizen Input

Chairperson Nixt called the public meeting to order at 8:32 p.m.

Merlin l lunt, 17860 Nowthen Boulevard stated he did not get a copy of the latest ordinance, but
asked il' this is only for developers or applies to individual homeowners.

Mr. Gordon stated there is a number of triggers.

Planning Commission/May 5, 2005
